Myanmar Faces Genocide Hearings at The Hague

Aung San is currently in Europe to face charges against her military goverment on charges of genocide against the Rohingya.

Looking at reports over the past 2 years i'd say her government is guilty of many things including murder, mass rape and destruction of property , but it will be hard to prove genocide. Even if found guilty, nothing will be done. Bangladesh has tried twice to get the Rohingya's around Cox bazaar to return home, but none are willing to go back as they do not feel safe or believe the Tatmadaw, ( Burmese military) will not do it all over again.
During three days of hearings starting Dec. 10, it will ask the 16-member panel of U.N. judges at the International Court of Justice (ICJ) to impose “provisional measures” to protect the Rohingya before the case can be heard in full.

More than 730,000 Rohingya Muslims have fled Myanmar to neighboring Bangladesh since a 2017 military crackdown, which U.N. investigators found in August to have been carried out with “genocidal intent.” Myanmar vehemently denies allegations of genocide.

The office of Myanmar’s civilian leader Aung San Suu Kyi, a Nobel peace prize laureate, has said she will lead her country’s defense personally. Myanmar’s legal team is expected to argue that genocide did not occur, that the top U.N. court lacks jurisdiction and that the case fails to meet a requirement that a dispute exists between Myanmar and Gambia.
“But in law genocidal intent has to be established beyond reasonable doubt. It shouldn’t be confused with personal motive prompting actions of a perpetrator. There must be sufficient evidence to prove, beyond a reasonable doubt, a policy to destroy the group.”

Myanmar has previously denied almost all allegations made by refugees against its troops, including of mass rape, killings and arson. It says the army was engaged in a legitimate counterterrorism operation against Rohingya militants.

The U.N. investigators concluded that sexual violence committed by Myanmar troops against Rohingya women and girls in 2017 indicated the military intended to destroy the mainly Muslim ethnic minority.

On Monday the Netherlands and Canada put out a joint statement in support of Gambia, the tiny, mainly Muslim West African country that filed the suit in which the Buddhist-majority Myanmar is accused of genocide against its
Rohingya Muslim minority.

During three days of hearings, Gambia’s legal team will ask the 17-member panel of U.N judges at the ICJ to impose “provisional measures” to protect the Rohingya before the case can be heard in full.

“The international community regards Myanmar’s persecution of its Rohingya as a crime against humanity. But for the ethnic Bamar majority in Myanmar, this act remains very popular. Aung San Suu Kyi is clearly more concerned about her domestic supporters than the judgment of history.”

agree; before she was a hero to the international community speaking out against the Tatmadaw, BUT once elected she needed to appease the largely Buddhists locals to stay in office. Elections next year, if she says ANYTHING in support of the Rohingya, she doesn't stand a chance of staying in office

The local Buddhist population,( monks included) hates the Rohingya's and deny's they are Burmese

Three I.D.P. camps have already been closed and an I.D.P. camp closure strategy has been adopted. Myanmar is also committed to the voluntary, safe and dignified repatriation of displaced persons from Rakhine under the framework agreement reached between Bangladesh and Myanmar. Mr. President, how can there be an ongoing genocide or genocidal intent when these concrete steps are being taken in Rakhine? Muslims are not a party to this conflict, but may, like other civilians in the conflict area, be affected by security measures that are in place. We pray the court to refrain from taking any action that might aggravate the ongoing conflict and armed conflict and peace, and security in Rakhine. Please bear in mind this complex situation and a challenge to sovereignty and security in our country when you’re assessing the intent of those who attempted to deal with the rebellion. THE HAGUE — “Intercommunal violence.” Action against “insurgents or terrorists.” Possible — only possible — use of “disproportionate force.” But not genocide.

A day after Daw Aung San Suu Kyi listened impassively to searing testimony about the horrors inflicted upon the Rohingya Muslims of Myanmar, she took the podium on Wednesday at the United Nations’ highest court to defend her homeland against accusations of genocide, arguing that there had been no orchestrated campaign of persecution.

Her statement at the International Court of Justice in The Hague capped a jarring turnabout, decades in the making, for Ms. Aung San Suu Kyi, from champion of human rights and democracy to apparent apologist for brutality. She won the Nobel Peace Prize in 1991 for her ramrod resistance to the former military dictatorship that held her under house arrest for 15 years.

she insisted that what foreign observers have called an organized, years-long campaign of atrocities against the Rohingya has been exaggerated and misconstrued, whether out of malice or just ignorance. She did not even use the word “Rohingya,” adhering to her government’s stance that no such ethnic group exists.

“Genocidal intent cannot be the only hypothesis,” she said on the second day of a three-day hearing, before launching into a litany of ways in which she said her government was trying to lift up the Rohingya from dire poverty.

Olav Njoelstad, the secretary of the Norwegian Nobel Committee, said : “It’s important to remember that a Nobel prize, whether in physics, literature or peace, is awarded for some prize-worthy effort or achievement of the past.

“Aung San Suu Kyi won the Nobel peace prize for her fight for democracy and freedom up until 1991, the year she was awarded the prize.”

The rules regulating the Nobel prizes did not allow for a prize to be withdrawn, he said.

In 2017 the head of the committee, Berit Reiss-Andersen, also said it would not strip the award after previous criticism of Aung San Suu Kyi’s role in the Rohingya crisis.

“We don’t do it. It’s not our task to oversee or censor what a laureate does after the prize has been won,” she said. “The prizewinners themselves have to safeguard their own reputations.”
