Joe Biden too senile to prosecute.

Yeah, that place out 'there'. Anything not really Cambodia related should go here.

Joe Biden too senile to prosecute.

Post by Doc67 »

It appears that President Biden escaped prosecution because he is an "old man with a significantly limited memory".
He can't have it both ways; if he is unfit to prosecute he is unfit to govern. On this basis, how can he continue to serve until the end of his term? At least Regan has Bush by his side. Nobody wants Harris, now or in the future. Good news for Trump.

Among the reasons Hur gave for not bringing charges was a concern that jurors would not believe that Biden knowingly kept the documents. The special counsel explicitly referenced the 81-year-old’s “significantly limited” memory – an incendiary topic in this year’s election – including his inability to remember what year his son Beau died.

“We have also considered that, at trial, Mr Biden would likely present himself to a jury, as he did during our interview of him, as a sympathetic, well-meaning, elderly man with a poor memory,” Hur wrote.

“Based on our direct interactions with and observations of him, he is someone for whom many jurors will want to identify reasonable doubt. It would be difficult to convince a jury that they should convict him – by then a former president well into his eighties – of a serious felony that requires a mental state of willfulness.”

Add to this his recent gaffs claiming to have spoken to Helmut Kohl in 2020. Kohl dies in 2017
On Wednesday at a campaign fundraiser in New York, Biden reportedly referred to the former German chancellor Helmut Kohl as talking to him about European concerns about the attempt to stop the certification of his 2020 election win, when he apparently meant Angela Merkel. Kohl died in 2017.

Previously on Sunday, Biden in Nevada apparently confused François Mitterrand, the former French president who died in 1996, for France’s current president, Emmanuel Macron, while recounting a similar anecdote about the events of 6 January and European fears over them.

"Biden described as ‘elderly man with poor memory’ in classified documents report – as it happened"

From a 1996 election bumper sticker
“If God had intended us to vote, he would have given us candidates"

so goes it for the 2024 election

With all due respect to that political system; isn’t this why there’s a Vice President? Someone to assume the position when the president is no longer competent.

Shouldn’t Kamala Harris be required to take the reins?
Who makes that call? Senate?

Let Biden finish out his term and run for re-election.

Trying to replace him based on unfit for office (especially if successful) creates a dangerous new precedent. A political threatening tool. One that can be used anytime in the future when congress disagrees with the President.

Each branch is supposed to be separate but equal and thus keep each other in check.

The President is the one who supposed to make the tough choices. Especially the unpopular ones.

My thoughts, of course.

Here in lies the situation and why Biden will lose
Anyone who votes for Biden knows that Kamala will be president ( vice pres takes over if for any reason the president cant perform his duties or dies ) before the 4 years is up, ( no way will he make it another 4 years) and they dont like her
so they wont vote>
All no voters means that Trump will take it and
if you think things are bad now, just wait

I assumed when they gave Joe the Job that he was a Dem trojan horse to get the first woman prez into power by wheeling him off to the nursing home after a few months and letting Harris take over

It's beginning to remind me of Lloyd bridges in Hot Shots Part deux

25 the Amendment. AI summarized, of course.

“According to the 25th Amendment, Congress decides if a president is unable to perform their duties. The amendment was ratified in 1967 and provides procedures for replacing the president or vice president in the event of incapacitation.
The amendment states that if the vice president and a majority of the Cabinet believe the president is unable to perform their duties, they must send a written declaration to the Senate president pro-tempore and the speaker of the House. If two-thirds of both the House of Representatives and Senate vote in favor, the vice president will assume the power of the presidency.
The 25th Amendment also establishes the order of presidential succession and contingency plans for filling executive vacancies. “

There is an extremely high threshold for this to happen. A safeguard from preventing a hostile majority from removing the president and vice president (same party) and going to the speaker of the House (different party). Or just using it as a way to threaten the President to get what they want.

Only used when a President dies in office. Clearly a dead president cannot perform his duties.
