Appeal Denied for Robber who Caused Death of 15Yo Boy
Cambodia News, (Phnom Penh): On February 20, 2023, the Supreme Court upheld the sentence of a 25-year-old man, who had appealed the 7 year prison sentence previously handed down by the Banteay Meanchey Provincial Court. Mr. You Ottara, Chief Judge of the Supreme Court, stated that the accused was named Soeuth Chet, male, 25 years old (born in 1995) in Tabao village, Bosbov commune, Preah Net Preah district.
The defendent was one of a gang of three armed men who were chasing after a 15-year-old boy on a motorbike, intending to rob him, when the victim panicked and drove into a broken canal where he was killed outright, in Phas village, Banteay Meanchey province during 2020. The victim was named as Chheay Thorn, male, 15 years old, in Phas Cheung Village, Sarong Commune, Banteay Meanchey Province.
The defendent and his accomplices were arrested on May 6, 2020 in Phas Khang Tbong village, Sarong commune, Svay Chek district, Banteay Meanchey province. He was sentenced by the Banteay Meanchey Provincial Court on September 22, 2021 to 7 years imprisonment and ordered to pay 4 million Riels in compensation to the victim's family for "intentional violence aggravated by the death of the victim ”, in accordance with the provisions of Article 224 of the Penal Code of Cambodia.
This sentence has now been upheld by the Phnom Penh Supreme Court on appeal.

Good! He didn't get off.
According to the facts we have, he tried to rob a young lad and by doing so caused his death.
No doubt he didn't mean to cause death but he must've been aware of the possible consequences of his actions.
7 years seems about fair to me, though it goes without saying I'd want more if it'd been my son who'd been the victim.
