Shooting dead a robber in the back - will he be convicted?

So an American customer shot dead a man who robbed a cafe/restaurant he was at. The man was shot after he had walked past the customer - in the back.
The robber had a fake gun.

I think the customer will face charges. I’d be surprised if he got off with nothing. (But it’s Texas)

He went OTT, no need to shoot so many times & especially the final head shot.

I expect he'll be charged & rightly so.

As long as his gun is legally held he should not face a murder charge imo. It's in Texas after all

However the customers all left the robbery scene prior police arrival so police want to find and question him, naturally enough

Texas is a fucked up state, you don’t need a permit or license to open/conceal carry. Also no gun straw laws. So he won’t have any issues with that.

Nobody except the robber knows that the gun is fake until after the event. He’s still a threat until he’s left the building.

If it was a policeman, there’d surely be an excessive force charge. The difference between professionals* being prepared, and civilians having a go.

Don’t pull a weapon out unless you’re prepared to use it, and are ‘comfortable’ with the potential consequences. There’s fuck all point in doing all the important thinking afterwards.

If there ever was a demonstration needed as to why gun control is needed, this is a good candidate.
Too easy to discharge too many rounds by a person clearly unprepared to deal with a lethal situation that was exacerbated by the have a go attitude.


*Not going into the low professional standard demonstrated too frequently.

I probably would be quite pissed if I was the guy sat in the far corner. 9 shots is enough for 1 to go stray

A few years back a bloke in the Norwich area shot a couple of Travellers/Pikies/Gypsys (not sure what the current pc term is ?) who had broken into his farmhouse. he had huge support but went to prison anyway. Both thieves had a substantial criminal records ie professional burglars

Wouldn’t the fact the customer left and drove away go against him? There’s no way that’s the right thing to do
