Thai and Cambodian Charged with Trafficking 24Kg Ice, MDMA and Weapons

Cambodia News, (Phnom Penh): The Phnom Penh Municipal Court on the morning of December 20, 2022, tried two defendants, Thai and Khmer, in connection with the trafficking a total of more than 28 kilograms of illegal drugs in Phnom Penh during 2021.

Mr. Nhim Pisal, President of the Trial Chamber of the Phnom Penh Municipal Court, said that the two accused are:
1. Kim Samphok, male, 39 years old, Cambodian.
2. Prak Set, male, 54 years old, Thai nationality.
They were arrested in Phnom Penh on August 18, 2021.

The judge stated that in this case, the accused are charged with "illegal possession, transportation and trafficking of drugs and possession of weapons without permission under Articles 40 and 20 of the Law on Inspection of drugs and laws on the control of weapons, explosives and ammunition."

After the arrest, the police confiscated the following exhibits: 24 large packages of methamphetamine (ICE) of approximately 1kg, weighing more than a total of 24 kg , 14 packages of ecstasy (MDMA) weighing about 4 kg, and six mobile phones, a Macrolo pistol, three shell casings and three unexploded ordnance.
The Phnom Penh Municipal Court will announce the verdict on the afternoon of January 19, 2023.

PP Court completes hearing drug trafficking case involving businessman
[excerpts]
Deputy Prosecutor Rithy named the Cambodian national as Kim Samphouk, a 39-year-old real estate businessman, and the Thai national as 55-year-old Prak Seuth, a Chinese-Thai translator and his driver.

He said that both were charged with drug transporting and trafficking under Article 40 of the Cambodian Law on Drugs Control, with unauthorised possession of a weapon under Article 490 of the Criminal Code and with Money Laundering under Articles 27 and 38 of the Law on Anti-Money Laundering and Financing.

At yesterday’s hearing, Samphouk denied the allegations, saying he was not a drug trafficker or had committed anything as charged and told the court that Seuth and other workers were living in his house from where the police found the drugs.

“I am innocent and want the court to drop the charges and release me from prison,” Samphouk told the court.

Seuth admitted to committing the offence, saying that the drugs found and seized from Phouk’s house belonged to him alone.
Seuth confessed that he bought them from a Cambodian man named Vibol, who had been at large on the day of his arrest.

First time I have seen that mentioned.

I wonder if the AML laws include post conviction forfeiture orders; they could quickly develop a taste for that.

UPDATE: Life Sentences
Cambodia News, (Phnom Penh): The Phnom Penh Municipal Court on March 15, 2023, sentenced a Thai and a Cambodian man to life imprisonment and a 60 million riel fine each, for the transportation and trafficking of nearly 24 kilograms of drugs. The men were accused and found guilty of transporting the drug Methamphetamine from the Laos-Cambodia border to Phnom Penh in 2021.
