My agent said that because my present visa extension was made prior to October 17th they don't require evidence of wp. I have wp anyhow so doesn't really matter either way

I have a technical question.

My new passport has arrived, my old one has been cancelled. My Visa expires on Feb 6th and is an EB EOS. I have no WP and never have, I have been here for 5 years.

Q1:
I'm was planning to apply for my first ER visa, as an EOS, converting from my current EB EOS. Will they want the WP fees for all the time I have been here on an EB EOS without a WP, even though I am now applying for an ER EOS?

I am planning a short 4 day trip abroad in January and I will exit on my old cancelled passport ( to hand in the entry card and show how I got into the country) and re-enter on my new passport.

Q2:
Can I re-renter using my current visa in my cancelled passport, or is it better to simply apply for a new Ordinary visa at the airport and covert that into an ER EOS. This will allow my old visa to expire with the passport it was issued in having left the country, thus closing the book on all those years of EB EOS without a WP ever being produced.

Will this work? Will I be able to start afresh and without anyone nosing around trying to backdate WP charges?

Q1: You will not be charged retroactive WP fees when applying for an ER from an EB...you only have to pay the retroactive fees when applying for a WP, which you won't need to do if applying for an ER EOS.

Q2: You can just apply for a new E-type VOA when you return, they will probably ask why since you still have a valid EOS in your cancelled passport, just tell them you list that passport, no issue...or you can reenter with the valid EB EOS in your cancelled passport and then apply for the ER when it's time to renew, either way you won't be charged retroactive WP fees as per my answer to Q1.
