Cannot clear or take land around the lake, but can fill in the lakes and take that land as your own. Sorry , I mean lease for 99 years.

The Banteay Meanchey Provincial Court on December 22 detained a commune chief in Preah Netr Preah district and a reporter from the Khmer Student News Unit on charges of illegal encroachment, occupation and sale of state land that is part of Region 3 of the Tonle Sap Lake wetlands.

Samrith Sokhon, the prosecutor’s office spokesman, told The Post on the afternoon of December 22 that 60-year-old Em Nouy – chief of Phnom Leap commune – was arrested on December 18 after the provincial administration’s expert committee investigated and found that he was involved in the illegal encroachment upon flooded forest land totalling 110ha.

In 2018 and 2019, Nouy allegedly sold the land to six families for $39,700 and 110,000 baht, he added.

Chhum Thou, 57, a reporter for the Khmer Student News residing in Peam Kampong Krasaing village of Preah Net Preah district’s Phnom Leap commune, was also arrested by police officers assigned to the joint force on December 18.

Thou is accused of clearing and occupying flooded forest land totalling 200ha in Region 3 at the Ang Ly Sam An area of Krabao village in Preah Net Preah district’s Phnom Leap commune in 2018 and 2019.

“The two suspects were remanded into the custody of the provincial prison by the investigating judge on charges of encroachment, possession and sale of state-owned flooded forest land under Article 98 of the Law on Fisheries,” he said.

Three district governors in Kampong Chhnang were relieved of their positions by HE on Wednesday, but authorities say that this is not at all connected to the current crackdown on officials who have been clearing and selling protected flooded forests in the district.

Prime Minister HE has ordered a revamp in the positions of three district governors in Kampong Chhnang province, according to sub-decrees signed by him on Wednesday.

They are Boribo district governor Yim Sarin and Choul Kiri district governor Hay Monorom, who have been transferred to work in the provincial administration, and Kampong Leng district governor Sam Chanthorn who has decided to retire and is currently working as the district chairman of the Cambodian People’s Party (CPP) committee.

Meanwhile, Kampong Chhnang authorities reported that 27,838.15 hectares of illegally cleared flooded forest in the province was returned to the state after a crackdowns to recover the state land.

Kampong Chhnang provincial governor Sun Sovanrith told Khmer Times yesterday that the revamp of the positions of the three district was not related to clearing of the flooded forest land and was a usual rotation exercise.

“The three district governors were replaced because they had already served their eight year terms and therefore the provincial administration had to give their positions to others,” he said.

Kampong Thom’s deforestation prevention measure gets military backing

The Kampong Thom military forces joined in the fight against deforestation and land encroachment in Tonle Sap’s flooded forest land.

On the morning of December 24, the Commander of Kampong Thom Military Operation Area, Maj. Gen. Som Sun, disseminated information on the use of the armed forces and the Commander reported that in compliance to the order of the Commander of the Royal Cambodian Armed Forces, Lt Gen. HM, the armed forces will be participating in preventing deforestation and encroachment in the Tonle Sap area.

Maj. Gen. Sun also praised the forces that have been actively cooperating with the relevant authorities to research data, inspect target areas, and update demarcation poles in the three areas of the Tonle Sap swamp forest.

The Major General issued an order for all forces to cooperate to strictly implement and participate in the rehabilitation of the flooded forest in Kampong Thom. The armed forces are to participate in the replanting of trees in deforested areas in the flooded forest with the local authorities.

More flooded forest returned to state

Authorities in the provinces around the Tonle Sap lake claim that so far this month no citizens or officials have had court cases filed against them for encroachment of flooded forest land as people had returned such land to the state, although investigations are ongoing.

Kampong Thom provincial deputy governor Sok Hay yesterday told Khmer Times that so far, more than 1,200 hectares of flooded forest land have been handed over to the state. There are about 50,000 hectares of flooded forest in the province.

Hay said that the Fisheries Department has inspected and planted more than 104 border posts in Zones 2 and 3 and will continue to plant more to clearly demarcate the border.

He could not confirm how many people in the province had been referred to court by the authorities as they are still investigating some cases.

Banteay Meanchey Provincial Information Department spokesman Sek Sokhom said that more than 4,000 hectares of flooded forest land had now been returned to provincial authorities of the 5,000 hectares of land that was illegally encroached upon.

60,000ha of flooded forest returned to state

The Fisheries Administration confirmed that so far more than 60,000 hectares of flooded forest land have been reclaimed from more than 14,000 families.

Fisheries Administration deputy director Ing Try told Khmer Times yesterday that the prevention and suppression of encroachment, clearing and confiscation of flooded forest land around Tonle Sap lake as of Sunday by the authorities facilitated 60,630 hectares being voluntarily returned to the state from 14,490 families.

Try added that so far, authorities have planted 34,911 flooded forest trees, 7,689 bamboo trees, 339 palm trees and planted 205,385 palm seeds.

“The purpose of reclaiming flooded forest land is to restore the natural resources of the Tonle Sap lake,” he said.

Try added that he could not confirm the number of border posts around the Tonle Sap lake that had been lost in the past, while authorities were still gradually erecting new posts and have not yet reported the data.

Kampong Chhnang provincial governor Sun Sovanrith said that more than 7,000 families voluntarily returned more than 30,000 hectares of flooded land that they illegally encroached on in the province.

“The people who came to self-declare so far are 7,531, covering an area of 30,589 hectares,” Sovanrith said.

Kampong Thom Governor pushes for protection of protected areas
The Governor Ngoun Ratanak urged all locals to help protect the flooded forests in the province.

The Governor made the remark while leading a group of officials to plant seeds and saplings in deforested areas of Chamna Krom Commune, Stoung District on January 27.

Governor Ratanak urged all people to help protect the flooded forests and join efforts to rehabilitate them. The Governor also reminded local authorities to cooperate with relevant forces to protect the flooded forest and newly planted saplings, as well as to prevent forest fires in the dry season.

The Governor emphasized that forests play an important role in maintaining the ecosystem and reducing the negative effects of climate change. He continued that the trees are important natural resources for the residents of the area.
