Armed Guards Descend on Protesters From Luxury Gated Community

About 30 armed guards descended on a leafy Chip Mong-owned gated complex on Monday evening after residents — including Acleda Bank CEO In Channy — protested a plan to fill in a water feature, with some homeowners hanging protest banners on their mansions.

“They came to remove the banners while I was looking after my two children,” said resident Por Punareay, who argued that she was within her rights to put a banner on her gate. “They were all wearing uniforms. … I still feel frightened.”

The residents are seeking to halt Chip Mong’s plan to fill a 10-hectare pond near the golf course on the property.

“We love the environment,” Punareay said. “But now we regret that we bought the house. … When Chip Mong came, they started to act like this and threaten people.”

A banner seen on Monday morning on the gate of one large house read: “Protect the lake and golf course in Grand Phnom Penh according to the Master Plan that was advertised.”

Previous owners sold the housing complex to Chip Mong in October last year, Channy said.

The bank executive and housing protester said residents had the right to put up banners on their homes. But the banners initially went missing on Thursday, and some plain-clothed armed men showed up to the neighborhood, he said.

“There was a threat with weapons, by displaying their small guns. We don’t know where they came from, but they took pictures of our houses while showing the guns in their holsters,” Channy said. “This is a threat and intimidation to frighten us who are living in peace. This area is in the center of Phnom Penh and the company dares to do this.”

Representatives for Chip Mong Land, part of tycoon Pheap Heak’s sprawling Chip Mong Group, could not be reached for comment.

“When we met the company on the 10th, [representatives] said they will fill up the lake and if we did not go along, they would cut off our electricity,” Channy said.

Following complaints from the residents of Grand Phnom Penh Borey, Governor Khoung Sreng said he cannot stop Chip Mong from filling in the borey’s pond.

PHNOM PENH--Chip Mong’s plan to fill a 10-hectare pond in Grand Phnom Penh in Sen Sok District is private property and City Hall has no right to intervene, according to the city’s governor.

Responding to the representatives of 140 families who are protesting against Chip Mong’s decision to fill a 10-hectare pond in Grand Phnom Penh Borey, Phnom Penh governor Khuong Sreng said that his administration does not have a sufficient legal basis to intervene. Therefore, he said he could not prevent the filling in of the pond.

Sreng said that if the Phnom Penh administration intervenes to save the pond, it will be a violation of Article 85 and Article 88 of Land Law.

The 140 residents of the borey have been protesting since the weekend, arguing that the pond was part of what drew them to the luxury gated community. Local media reported armed security forces being deployed to intimidate the residents.

According to the relevant documents, the pond belongs to tycoon Leang Khun and tycoon Leang Meng, who bought it from YLP Group last year, City Hall added.

Chip Mong Land could not be reached on the morning of Sept. 29, but according to local media, Chip Mong confirmed that the company still intends to develop the pond, despite some residents’ protests.

The company plans to transform the pond into a mixed green park with lots of trees, a gym, a children's play area, called “Central Park.”

The ongoing dispute has drawn the ire of social media users in Cambodia who pointed out that land disputes have been an ongoing problem throughout the country, but now they are finally affecting even the richest members of society.

Municipal officials unable to intervene in private lake dispute

Phnom Penh municipal governor Khuong Sreng said he has no legal grounds to intervene in a plan by Chip Mong Land to fill more than 10ha of the lake in the Grand Phnom Penh Satellite City because it is not public property.

Sreng was responding to a petition filed by 140 people at the Phnom Penh Municipal Hall, the Ministry of Environment and the Ministry of Land Management, Urban Planning and Construction.

Chip Mong Land bought the land from YLP Ciputra Group and promised to keep the lake in line with the master plan.

Sreng wrote in a September 28 letter that the lake is private property with a title deed registered at the Phnom Penh Municipal Department of Land Management.

“Any Phnom Penh municipal administration’s intervention to stop the filling of the pond will violate Articles 85 and 86 of the Land Law. So, the Phnom Penh municipal administration cannot stop it,” the letter read.

Acleda Bank Plc president and group managing director In Channy, who is representing the 140 people told The Post on Tuesday that they have stopped the protests.

“The Phnom Penh Municipal Hall issued a notification and we stopped the protests because we have to follow [the letter],” he said.

The joint petition said people living in the community in the Grand Phnom Penh Satellite City bought houses based on the master plan which contains a lake, a golf course and a large park.

The petition said the houses at the edge of the lake are very expensive.


Chip Mong Land could not be reached for comment on Tuesday. According to the petition, the company announced that the lake will be filled to establish a new housing project.

Article 84:
The usufructuary shall benefit from the fertilization of the alluvium on the soil which he got from the usufruct.

Article 85:
The usufructuary uses all the easements and, in general, all the rights that the owner can use, the usufructuary can use those rights as well.

Article 86:
The usufructuary shall get the quarry in the perimeter of his/her land which he/she got from usufruct as well as the owner does.

Will all depend on the collective wealth and status of the Borey residents vs. Chip Mong.

Wish it was a western country. There would be a tell all book eventually. Would be a best seller.

What the hell is a usufructuary? If the company owns the land I guess they can do whatever they want. It would be amusing if it turned out that their water supply comes from the pond.
