American facing jail for negative reviews of Thai resort

Thailand is Cambodia's neighbor to the West, and this forum is dedicated to Thai news, stories, reviews, blogs, videos, Thai people and anything else related to the country. A lot of expats have both lived and worked in Cambodia and Thailand, and this area is a place to discuss all aspects of life in Thailand and what's going on there. Most topics are about Bangkok and Pattaya because of their larger populations of expatriates and tourists in those cities, but this is for all things Thai.

When I read people saying that he posted multiple reviews on multiple sites someone clarify what this actually entailed.

Was it:-

1: Posting 1 review for himself to a number of different review sites
or
2: Posting more than 1 review for himself to a number of review sites.

There is nothing to stop a disgruntled customer posting a review to a site no matter the basis for his review. The customer can then goto another review site and lodge the same review. If, however, the disgruntled customer uses multiple sock accounts to post reviews then this would be in violation of the terms of service for that review site.

I, myself, have copy pasted the exact same review to a few places on Google Maps and TripAdvsor. If the booking was made through a booking site, where you can only leave a review if you make a booking, I may leave a review on there as well as the other two.

Will this be a positive thing for the Thai tourist industry ?
I've never written a review but isn't it quite common for people to write bad reviews in other countries, without this sort of repercussions?
Was it in total four bad reviews?

I think it still looks bad for Thailand in general.

I agree. This guy isn’t the only person who has posted multiple bad reviews on a review site. It happens enough for the sites to have procedures in place to combat it.
Some people have even taken replying to negative reviews to a whole new level.
Google “White Moose cafe, Dublin fighting bad reviews” to see how one owner turned it into a marketing strategy.
Also, getting back to the business in question, if you check the history of negative reviews they have received in the past you will see other complaints regarding the attitude of the manager so this tends to add weight to the argument that the manager doesn’t deal with problems that well.

Thai Hotel That Put American in Jail Gets New Label on Tripadvisor

https://news.yahoo.com/thai-hotel-put-a ... 58353.html
BANGKOK — The resort hotel in Thailand got its public apology. The unhappy American guest who spent two nights in jail for criticizing the hotel online got his criminal charges dropped. But it was Tripadvisor, the giant online travel review platform, that got the last word.

Wesley Barnes, the American traveler who was arrested after being charged with criminal defamation for posting critical reviews of the Sea View resort on the island of Koh Chang, quietly left Thailand this week.

With Barnes safely out of the country, Tripadvisor took punitive action Wednesday against the resort, posting a one-of-a-kind notice on the Sea View’s page warning travelers that the hotel was behind the jailing of a guest for his harsh reviews.

“Thailand’s use of criminal defamation is really off the charts,” said Phil Robertson, the deputy Asia director for Human Rights Watch. “It seems like the Asian notion of ‘saving face’ has really been taken to heart by Thais who don’t hesitate to head to court over the smallest perceived slight or insult. If Thailand would simply decriminalize defamation, making it a purely civil law matter, this would create a major change in Thai society overnight.”.....

So let me get this straight:

tripadvisor paid his legal fees.
Tripadvisor said they wouldn’t post a red notice on their site as part of a plea deal.
Tripadvisor made sure the guy was safe and out of the country before implementing their final act.
Thus...
Tripadvisor circumvented the plea deal agreement by creating a new type of warning

Tripadvisor royally screwed them all and hopefully sent a message to others about using threats of legal action to suppress pissed off customers.

They should name the manager who initiated this whole scam and blacklist him in the hotel and tourism industry.

Anybody know his name and nationality?

Tripadvisor CEO Steve Kaufer said he doubted any tourism board would want their destination known as one that jails people who write hotel or restaurant reviews. “This extraordinary action is why we have taken steps to issue an alert.”

......
A Massachusetts-based company, Tripadvisor has operated for 20 years and has posted 878 million reviews from countries around the world. It usually has 50 to 100 lawsuits pending in various countries, most commonly about free speech, Mr. Young said.

“Every traveler,” he said, “has a fundamental right to share their experiences and opinions with other travelers.”

Good.......sends a message to Thais.

Your thin-skin, arrogant, elitist, bullying bullshit may go over well in your land of 'smiles'. But the western world just told you where you can stick that. :thumb:
