The term statutory rape is confusing because it is a misnomer for underage sex. I think the laws are more nuanced now and take into account age differences but there are cases of two 17yos having an ongoing sexual relationship, one of them turns and 18 and becomes a rapist in the eyes of the law.

Consent is pretty nebulous as well and is irrelevant to most social interactions. If you change the definition of rape from one that has been used by multiple legal systems over the course of thousands of years to something that sounded good in the abstract but is rarely applied in real life you should expect plenty of confusion.
