Your bank issues a credit while they investigate whether your chargeback was valid or not. If your tickets were non-refundable then it was not, so yes the charge will go back to you. As I posted before, AirAsia offered two alternatives for your bookings so maybe stop complaining and take them up on one of their offers.

Flights booked in Australia do come under Australian law, even for foreign companies operating in Australia.

I don't think if I'm physically in Australia and I buy a ticket from Nepal airways that's a flight booked in Australia. At least in Europe, it isn't.

Anyway, even in Europe where the rules / laws are really customer friendly airlines and ticket seller are breaching laws on a massive scale, often backed up by governments which are scared their national carrier will go bust.

If you are physically in Australia when you book the ticket, including when you book online. It would include buying a ticket through a travel agent in Australia, if you contacted them from outside Australia.

When I buy a ticket from outside Australia, I go to the Australian website. They know from my IP address that I am not in Australia, and they sell the ticket through another affiliated company. I have realized they do this intentionally, so my purchase is not covered by Australian law.

Next time I buy a ticket from outside Australia, I will see if another airline has competitive prices. If they do, I may go with the other airline.

The other option is to include the return ticket when you buy your ticket in Australia.

Australian based airlines should abide by Australian law, even when you buy a ticket from outside Australia.

If enough people complain to the ACCC about Air Asia, Air Asia will be forced to abide by Australian law, particularly for tickets bought in Australia. They will take action.

I think you have 2 seperate issues here which appear on face of it to be a single one.

Firstly is your right to a refund under Australian credit law when goods or services are not delivered. This seems to have been completed as per the bank's obligations.

Secondly is your contract with Air Asia. Just because you got your money back doesnt mean you had a right to it under the T&C's of the booking you made so you may still be liable for the payment and Air Asia could choose to pursue you for the monies owed. The answer to this will be in the terms and conditions under which you booked and according to the laws of the territory under which the contract is deemed to have been made.

I strongly encourage people to use other airlines.

I suggest you book a flight when it becomes official that borders are open, or you know planes are definitely flying. There is no point in booking a flight which may be there just to scam your money.
