Transwoman stands trial for posting naked photos online

Phnom Penh Municipal Court yesterday began the trial for the case of a transgender woman accused of distributing pornographic materials online.

Municipal Court Judge Keth Socheath identified the accused as Morn Eva, 28, a former masseuse working at a KTV bar in the capital’s Tuol Kork district.

Eva faces two charges of “pornography and indecent exposure” under Articles 38 and 39 of the Law on Suppression of Human Trafficking and Sexual Exploitation and Article 249 of the Criminal Code. If convicted, she faces up to one year in prison and a fine of between $50 to $500.

According to court documents, Eva was arrested on February 19 after uploading several photos of her genitals and a clip of her having sex on her Facebook account.

“She is a transwoman. She posted seven photos of her genitalia, which has just been changed from that of a man to a woman. She also posted a clip of her having sex with her partner on Facebook. She did acts that other women would not even think of doing,” said Judge Socheath.

“Her posts were shared and severely criticised by other users, who said she has brought disgrace to Khmer tradition and to the image of Cambodian women,” he said.

At yesterday’s trial, Eva admitted to committing the offence, saying she only did so because she wanted to show her friends and other men that she is now a woman and can therefore have sex with other men like any other women.

Eva added she was unaware that she was violating Cambodian laws, noting she only wanted to attract other men who might be interested in paying her for sex so she could make money to support her poor parents, who are living in Kampong Cham province’s Srei Santhor district.

She apologised for her deeds before appealing for a lighter sentence and an immediate release from prison as she claimed her genitals had been infected and has developed genital ulcers due to lack of proper hygiene in the prison where she has been detained.
