Cambodia News, (Phnom Penh): On 5 August, 2021, Sek Thuch, a 41-year-old Khmerican sports instructor, who was sentenced in September 2020, has requested the Judge of the Phnom Penh Court of Appeal to commute his sentence to 7 years and to reduce the civil compensation to the victim's family because he said he could not afford to pay.
The judge stated that in this case, Sek Thuch was sentenced by the Phnom Penh Municipal Court on September 25, 2020 to 10 years in prison and was ordered to pay the victim's family 80 million riels (approximately $ 20,000), for intentional aggravated violence resulting in the death of a victim under Article 224 of the Penal Code of the Kingdom of Cambodia.
However, the convicted man subsequently appealed the sentence before the Court of Appeal.
The Cambodian-American man was arrested on April 29, 2020, after he punched the victim on riverside in Phnom Penh, causing him to fall over backwards and hit the ground where he became unconscious. He died at the hospital five days and six nights later from serious injuries.
The victim, a 69-year-old Swiss man, had a valid passport and visa, and lived with his wife in a rented house in Street 13, Sangkat Wat Phnom, Khan Daun Penh, Phnom Penh.
During the trial, Sek Thuch admitted his guilt, but said he had no intention of punching the victim, but he punched the older man because he was angry at him for hitting his dog, which was playing with the victim's dog in a riverside park.
Sek Thuch asked the Phnom Penh Court of Appeal to commute his sentence from 10 years to 7 years and to reduce the civil compensation to the victim's family because he said he could not afford to pay.
The Court of Appeal will announce its verdict on the morning of August 28.

A sad story all round. Reminds me that one punch/push/slap or any form of assault can lead to something so tragic. Very sad.

Cambodia News, (Phnom Penh): The Court of Appeal on May 31, 2023, denied the appeal and upheld the sentence of 10 years in prison for an act of violence resulting in death, when the accused, Sek Thuch, 32, assaulted a Swiss man for hitting his dog at Sangkat Phsar Kandal I, Khan Daun Penh, Phnom Penh, on April 24, 2021. The 69-year-old Swiss expat died after he was punched by the younger man in a fit of rage, while both men were walking their dogs on the riverfront.
Sek Thuch, a Khmer-American man, was sentenced by the Phnom Penh Municipal Court in 2021 to 10 years in prison and ordered to pay 80 million Riels in compensation to the victim's family for "intentional violence causing the death of the victim ”, according to Article 224 of the Penal Code.
