Law on Victims Compensation for Victims of Federal Offences in Australia
Pursuant to section 21B of the Crimes Act 1914 (Cth), a court may order an offender to make some form of payment to a victim of crime.

Victims must let the Commonwealth Director of Public Prosecutions know prior to sentencing if they want the court to make a reparation order on their behalf.

Documentation that may be provided to the prosecution includes medical bills or receipts for counselling that are related to the crime.

A reparation order may be raised where the offender has been found guilty at a trial or hearing or entered pleas of guilty regarding a federal criminal offence, or offences.

How it works? A person who is convicted of a federal offence or he/she is sentenced without conviction for a federal offence, the court is permitted, in addition to the penalty imposed, order that the offender make reparation to the victim by way of money payment or otherwise in respect of any loss suffered or any expense incurred by reason of the offence.

However, section 21B(2) clearly states that a person is not to be imprisoned for a failure to pay an amount required to be paid under such an order.

Sexual intercourse with child outside Australia is a federal criminal offence, under section 272.8 of the Criminal Code Act 1995(Cth).

A person commits an offence if the person engages in sexual intercourse with another person (the child), the child is under 16 and the sexual intercourse is engaged in outside Australia.

Maximum penalties of 25 years imprisonment apply.

The maximum penalty for engaging in sexual activity (other than sexual intercourse) with a child where the sexual activity occurs outside Australia is 20-years imprisonment.

Tough laws in order to curb the offence were enacted in order to help prevent the global phenomenon of ‘child sex tourism’ in which offenders travel away from their home country in order to have sexual contact with children.

That sets out the legal basis for (a) the principle of reparation orders for victim IN Australia and (2) the offense of sex with minors outside it's own jurisdiction.

However, this case was lauded as one that was on course to create a legal precedent for (a) reparations of victims outside of Australia if they were victims of sexual assault as a minor.

This sums up the importance of this precedent:

The unprecedented request has national significance due to how, if successful, the challenge may set a precedent that allows victims from impoverished nations to use Commonwealth law to obtain reparations without a further lengthy and expensive lawsuit [emphasis added]


The prosecution authorities did have a clear view on this too:

“There is a national significance to this, and to the approach Your Honour takes,” commented Edward Stretton-Smith, for the Commonwealth Director of Public Prosecutions.


So how does Edward Stretton-Smith square this "national significance" with a private arrangement without a precedent for future claimants? Any future claim will have to start from scratch.

The opportunity to create a precedent has been lost. I doubt such a precedent from a state district court would be binding on equivalent level courts, and certainly would not be on appellate courts, but it would be very persuasive and would certainly set out the basis upon which a claim could be entertained.

Hopefully the government, who always have time to make laws to suit themselves, should make an amendment to the Crimes Act and codify the right to reparation payments to foreign victims of this class of crime.

This would remove all doubt in the matter. It will also add financial ruin to a long prison sentence.

Adelaide paedophile Geoffrey William Moyle sentenced over abuse of Cambodian children

An Adelaide man who admitted to filming himself sexually abusing children in Cambodia before publishing the videos online has been sentenced to eight years in prison.

Geoffrey William Moyle, 48, pleaded guilty to sexually assaulting multiple children between 2002 and 2005 while allegedly working as a foreign aid worker for the Department of Foreign Affairs and Trade, a claim DFAT has refuted.

Described as an Australian first, a "very generous" out-of-court settlement was reached between Moyle and one of his child victims, though an exact dollar figure was not specified.

Moyle was sentenced to eight years and nine months in prison with a non-parole period of four years and six months.

He was also sentenced to nine months for possessing child exploitation material in Australia in 2019.

In his sentencing remarks, Judge Paul Cuthbertson said Moyle was at a low risk of reoffending and described him as a "loving father, son and husband".

"He feels remorseful for his actions and takes responsibility for them," he said.

However, Judge Cuthbertson said he could not ignore the seriousness of the crimes.

"Over a period of approximately two to three years, the offender was involved in the most vile sexual activity against children of the age of about 10 to 12 years old," he said.

"He must have known the children he sexually assaulted will be exploited, that this activity towards them will likely wreck their lives and their futures."

In her impact statement, the only victim to be identified said she suffered serious trauma.

Judge Cuthberson told the court that she was very frightened and that Moyle treated her as if she was an object.

Moyle's nine-month state sentence for the child exploitation charges were backdated to when he was arrested in June 2019.

His Commonwealth sentence of eight years and nine months began at the end of that sentence.

He will be eligible for parole in 2024.

Speaking outside court today, Australian Federal Police (AFP) Detective Superintendent Gail McClure said law enforcement would "continue to work relentlessly to bring these sort of evil perpetrators to justice".

"I'd like to issue a warning to any other individual who would seek to prey upon vulnerable children: the AFP and its partners will come for you, no matter when the abuse occurred and no matter where you are in the world," she said.

"There's nowhere for you to hide."

Today, the South Australian District Court heard that Moyle and one of his child victims had reached a "very generous" out-of-court settlement, though an exact dollar figure was not specified.

Moyle's defence lawyer Heath Barklay today asked Judge Paul Cuthbertson to consider a "merciful" prison term since his client showed "good prospects for rehabilitation".

This sounds a bit contradictory. Out of court settlements are not court orders. If both parties want the terms of such a deal to be the subject of a court order they can apply to do so. However, the court does not have to give any legal reasoning in such an order. So, NO precedent. It sounds like, at best, the court has just rubber stamped this secret arrangement.

The court was considering the issue and has been usurped by these private negotiations. Indeed, Moyle has already paid the victim, further undermining the court's authority. This arrangement is now being paraded as evidence of the Moyle contrition and "good prospects for rehabilitation".

The judge, inexplicably, seems very happy about this:

Speaking in court today, Judge Cuthbertson congratulated both parties on reaching a reparation agreement outside of court.


This issue of compensation should have been a separate issue to the pre sentencing hearings and should have been decided post sentence. It was too important to conflate with the criminal proceedings and potentially influence the judge.

I see the article was silent on the prosecution's view of all this and whether they were even aware what was going on behind the scenes. The victim had independent counsel so it is quite possible they were blindsided too. I can't see they were too pleased, if for no other reason, they were quite likely to make legal history.

This seems to be an opportunity wasted.

Why do I get the feeling he got a light sentence because:

1. He reached an out of court settlement with one of the victims (that the court didn't have to decide on) and which the judge sees as an act of contrition,

2. He's now remorseful. Well, he would be wouldn't he? now that he's been pinged and he's hoping for a lighter sentence, and

3. The perp has since married, had kids and now has responsibilities as a "loving father, son and husband"

With parole the perp will have served only 4 and a half years.

What does his wife have to say regarding all of this?

Loving father ... I mean it's clear that he "loves" kids but isn't that the problem?

In an earlier post it says he met his wife in 2006. One post says he offended 2002-2005, another 2002-2006.

While he was married and supposedly 'being a loving father to his wife and kids'..:
"In a sporadic way he did from time to time access child exploitation material [on the internet]."

He had been "trading" material with other online predators" [and publishing videos online of himself sexually abusing children]

This comment by the judge made me feel ill.
South Australia is notorious for it's massive pedo ring, which includes judges, politicians, media people etc etc. Just sayin'
