US national accused of sex crimes against minor

A US national was charged by Siem Reap Provincial Court on Thursday over allegations of sexual crimes against a minor.
In a statement on Saturday, Action Pour Les Enfants said the suspect is 56-years-old and hails from Massachusetts.
It said the suspect was charged with purchasing child prostitution, child pornography and rape under the Law on Suppression of Human Trafficking and Sexual Exploitation.
Brigadier General Duong Thavary, deputy chief of provincial police in charge of the anti-human trafficking and juvenile protection department, yesterday said John Patrick Reidy was arrested by police in Siem Reap city on Wednesday at his rental home in Svay Dangkum commune after the victim’s parent filed a complaint.
“The suspect acknowledged that he had sex with the victim, but he said the victim told him he was 18, not 16,” she said. “They had sexual encounters multiple times since the beginning of this year. We arrested him based on the victim’s family complaint.”
According to APLE, the suspect was arrested after it reported its suspicion.
“Police commenced the investigation immediately after APLE reported the possible crime,” it said. “APLE received preliminary information from an NGO representative who obtained the concern from a community member.”
It said that according to police, the suspect was living with a Cambodian male adult who confirmed the two were in a romantic relationship.
“With approval from the court, police conducted a premise search and found a number of possibly incriminating items, including phones, vibrators, Viagra tablets and Vaseline,” it said. “Police confiscated these items for evidential purposes.”
“During the initial search of the two mobile phones, investigators found naked photographs of boys, including photographs of the child who disclosed the sexual abuse,” it added. “The police will continue the investigation with assistance from experts to collect further evidence from the mobile phones.”
It noted that APLE will provide legal support to the victim’s family.

Appeal Court hears child sex case involving US citizen
Phnom Penh Appeal Court yesterday heard the case of an American man who was last year convicted by Siem Reap Provincial Court over child prostitution and producing child pornography in 2019.
Presiding Judge Pov Phousun identified the accused as John Patrick Reidy, 58, a tourist from Massachusetts.
He said Reidy was sentenced on February 26 last year by Siem Reap Provincial Court to eight years in prison.
The provincial court fined him $1,000 and ordered him to pay $5,000 in compensation to the complainant in the case, an underage boy.
The accused was charged with “purchasing child prostitution and child pornography” under Articles 34 and 41 of the Cambodian Law on Suppression of Human Trafficking and Sexual Exploitation.
Judge Phousun said that Reidy was arrested on July 19, 2019 by the provincial anti-human trafficking and juvenile protection unit police in Siem Reap city in collaboration with APLE officers at his rental house in Svay Dangkum commune.
He said the accused was arrested after he had allegedly persuaded four Cambodian to have sex with him at his rental house in exchange for some money.
“After having sex with the boys, the accused took photographs of them while they were naked,” Judge Phousun said.
He added that after his arrest and inspected his rental house, police found naked photographs of the boys, including those of the child who disclosed the sexual abuse, as well as other related materials from his house.
During his appeal hearing yesterday, Reidy acknowledged that he had sex with the complainant but said the victim told him he was 19, not 16, at that time.
He confessed that he had sex with the victim several times in his house before his arrest.
A verdict is due on January 18. [2022]

American loses appeal against child sex conviction
Phnom Penh Appeal Court yesterday upheld the sentence of an American man who was convicted last year by the Siem Reap Provincial Court over child prostitution and producing child pornography in 2019.
Presiding Judge Pov Phousun identified the accused as John Patrick Reidy, 58, a tourist from Massachusetts.
“Based on the victim’s answers and the evidence that police seized from the accused John Patrick Reidy’s rental house in Siem Reap city during his arrest, the Judges’ Council of Phnom Penh Appeal Court has found him guilty as charged,” said Judge Phousun, who read out the verdict.
“The Judges’ Council of the Phnom Penh Appeal Court has considered that the ruling by Siem Reap Provincial Court was right and was made in accordance with Cambodian Laws, and the accused’s sentence given by the provincial court had been already reduced and is light,” he said. “Therefore, Phnom Penh Appeal Court has decided to uphold the ruling of Siem Reap Provincial Court as affected.”

Cambodia News, (Phnom Penh): The Supreme Court this morning, March 1, 2023, held a hearing on the appeal of an American man sentenced by a lower court to eight years in prison for sexual offenses against children committed in Taphul village, Svay Dangkum commune, Siem Reap city, during 2018.
Chiv Keng, the presiding judge of the Supreme Court, said the accused was identified as John Patrick REIDY, a 59-year-old United States passport holder. He said that Reidy was charged with purchasing child prostitution, production of child pornography (taking nude photos of children), and rape, under the Law on Suppression of Human Trafficking and Sexual Exploitation, Article 239 of the Penal Code, and was convicted and sentenced to 8 years imprisonment and fined 4 million Riel. The American man was arrested on March 6, 2019 in a house in Taphul village, Svay Dangkum commune, Siem Reap.
Reidy appealed his sentence before the Court of Appea,l which upheld his sentence. He has now appealed to the Supreme Court, which will announce the appeal verdict on the morning of March 9, 2023.
