Foreigners soon to be banned from certain jobs.

“I think the majority of foreigners who take these jobs are Vietnamese and Chinese nationals,” he said. “If foreigners open a business and register with the ministry, they can still do it, but if they are self-employed, it is not allowed.”
Sandra d’Amico, vice president of the Cambodian Federation of Employers and Business Associations, welcomed the move as it was fair and reasonable, and good for business.
Ms d’Amico added that it will also make Cambodia more competitive.
If someone now wants to open a restaurant but can't be self-employed (owner of their business). So what alternative! Buy/setup restaurant with your own monies, then turn it over too a Khmer at no cost and he/she can be your boss allowing yourself to now work, earn monies firstly for your boss and then yourself.

That is a good answer and one too be expected, being that same answer closed down so many bars in Thailand, due to the monies came from the partner, and was too undermine the authorities.

Are you saying Andy, that this was a common ruse by foreigners running businesses in Thailand - but the authorities woke up to it?AndyKK wrote: ↑Thu Aug 29, 2019 8:12 pmThat is a good answer and one too be expected, being that same answer closed down so many bars in Thailand, due to the monies came from the partner, and was too undermine the authorities.
(my comment was actually just a joke about who's boss around the house)

Yes I know it was, but I did cross reference if you like too what may not also be excepted since the authorities seem to be following labour laws of other countries. Do I predict the biggest change to come on the renewal of work permits.SternAAlbifrons wrote: ↑Thu Aug 29, 2019 8:30 pmAre you saying Andy, that this was a common ruse by foreigners running businesses in Thailand - but the authorities woke up to it?AndyKK wrote: ↑Thu Aug 29, 2019 8:12 pmThat is a good answer and one too be expected, being that same answer closed down so many bars in Thailand, due to the monies came from the partner, and was too undermine the authorities.

Your way wrong, business money can come from anywhere.Lots of bars are in gf/wife's or thai company names. Land was being questioned if the money came from a Westerner an some times paper was need to be signed stating it did not. They started cracking down on westerners using, "Thai Nominees" t o buy land to build homes on,(on advice of some lawyers) . I know a few tuk tuk drivers and ladies that own %%% of land worth tens of millions of $$> Of course they sign away all voting rights to said company that owns the land.
A westerner can own a business in Thailand, ( 49% foreign shares ...51% thai) and you can be issued a WP as a consultant
OR
if ur american, u can own 100% of said business/company and get a wp. BUT you cant buy land with an american owned company.
I think they are doing away with Barangs trying to get extensions for being self employed, (i take it to mean not owning a business but merely being a writer, photographer, online worker etc)
Because they dont qualify cause they are not married, over 55 or working for someone else
I've seen lots of threads about getting self employed EB extensions on here. So they seem to be closing that loophole

Re: Foreigners soon to be banned from certain jobs.
This to me indicates Cambodia wants to follow the Thai 'example' where a foreigner cannot own more than 49% of a business operation.Foreigners banned from running a small business and being self-employed.
The 'competent' authorities in Cambodia are so f*cking stupid.
They think Khmers can run operations above the level of street hawkers just like foreigners?
After more than 16 years here, I say: no, they (at least 99% of them) absolutely cannot. Just look at the level of 'service', 'maintenance', 'hygiene', 'general customer support', etc., Khmer-owned places 'offer'. Do I have to remind you that most, if not all, miserably fail?
So, implying - as the government apparently does - that Khmers can run operations like foreigners is just plain ignorance.
But anyway: to all foreign small business owners on this forum: sell your shit and get the fuck out of here, before it's too late.

Re: Foreigners soon to be banned from certain jobs.
I think there is a bit of these announcements that has been lost in translation, and I'm not sure what is their definition of 'self-employed'. However, trying to read between the lines in the above statement, I think the authorities are saying two things:AndyKK wrote: ↑Thu Aug 29, 2019 7:30 pm Quote from article -
“I think the majority of foreigners who take these jobs are Vietnamese and Chinese nationals,” he said. “If foreigners open a business and register with the ministry, they can still do it, but if they are self-employed, it is not allowed.”
The first is that if you want to run a business in Cambodia, you must register with the authorities. That means you must pay local taxes, income tax, and whatever other taxes are due. That's one thing.
The other thing is that the directive is probably specifically targeting Chinese businesses in places such as Sihanoukville where the "foreigners" (Chinese nationals) have taken over almost all the jobs and small businesses from local people, which is causing social discontent.
I think that the authorities want foreigners to pay taxes, and they want some sort of control over the job market to avoid social unrest. When you read declarations about "foreigners", don't automatically think that they are out to get westerners. We are insignificant in the big scheme of things. All this is just my opinion, of course.
Re: Foreigners soon to be banned from certain jobs.
It means you must have a company and be paying yourself a salary and all relevant taxes. If you receive a salary, you are not self employed. You are employed by a company. Doesn't matter the nationality of your boss, or even if you are the boss. The "self employed" label only refers to people who earn money based directly on the profits of their labor.AndyKK wrote: ↑Thu Aug 29, 2019 7:12 pm"Foreigners are also banned from running a small business and being self-employed". So what can the foreigner actually do regarding work? It sounds that he/she is banned from all work unless he is employed by a Khmer boss.phuketrichard wrote: ↑Thu Aug 29, 2019 4:55 pm Is this really true?? takes it a step beyond the PP post link

“A self-employed person refers to those who work and have income without an employer,” Mr Samheng said in the directive.
He said that the Labour Ministry will no longer issue or renew work permits for foreigners working these jobs, and those who failed to comply with the directive could be punished under the Labour Laws.

Crackdown on foreign workers welcomed
Locals have reacted enthusiastically to a government directive forbidding self-employed foreign nationals from undertaking work in 10 small-business categories.
“A self-employed person refers to those who work and earn an income without an employer,” Labour Minister Ith Samheng says in the directive, adding that the ministry will no longer issue or renew work permits for foreigners doing 10 listed menial jobs.
Cambodia has about 10,000 self-employed foreign nationals. Among them, 5,000 to 7,000 self-employed foreigners work in micro-jobs and small businesses, says Heng Sour, a spokesperson from the Ministry of Labour and Vocational Training.
In order to enforce the directive, Heng says the Labour Ministry will no longer issue or renew work permits for foreigners working in these jobs.
“The Labour Ministry and Interior Ministry have joint group and work inspectors in each provincial department and cities across the country. Immigration officers will also investigate enterprises and jobs handled by people,” Heng adds. The authorities are also allowed to stop foreigners who may have ignored the directive.
