Cambodia’s Fatal Building Collapse Survivors Relive Hours Before Rescue

Enveloped in total darkness, breathing air tainted by the smell of rotting bodies, their hopes faded under the rubble of a building erected without proper permits amid a building boom fueled by Chinese money.
Not too long ago, Un Neng dropped out of seventh grade in Kratie Province to join her parents working at a construction site in Sihanoukville, a sleepy coastal city now undergoing a casino building boom fueled by Chinese investors and encouraged by the government of Prime Minister HE.
Most of the time, Un Neng, 16, carried baskets filled with lime mortar to the skilled workers at a condominium under construction. Up, up, up she went, past the third floor, past the fifth floor, and on to the top floor, the seventh.
For Un Neng and her parents, it was a work-for-home opportunity because in Preah Sihanouk Province the white-hot real estate market makes it impossible for workers to live anywhere outside the shells of buildings they’re hired to construct.

On Friday, June 21, Un Neng ate dinner with her parents, Tep Ney and Prum Den, both 45 years old, then she fell asleep in a structure that was about 80% complete, even though no permit had been filed to allow construction to begin.
About 4:45 a.m. Saturday, just about a half-hour before dawn, the building collapsed.

Ban on living inside buildings under construction
Land management minister Chea Sophara has banned construction workers from using the construction sites they are hired to work on as their temporary shelters in order to prevent risk of fatality.
During a meeting with representatives of construction companies, contactors, and workers on Thursday evening, Mr Sophara said construction companies and contractors must make necessary arrangements for their workers to sleep off the site of their work.
“There will be no shelters for workers in the under-construction building. This will not be allowed to happen anymore,” he said. “No one is allowed to live inside a building under construction.”

UPDATE: There was a lot of media coverage of this terrible but predictable catastrophe in Sihanoukville, with the highest authorities present at the rescue scene, but many months later the victims and their families are still waiting for justice.

The families said they have received “empty justice” because the suspects charged over the collapse were not convicted.
Tep Samrith, 32, who lost three family members, including his 43-year-old brother Tep Meng, during the collapse said yesterday a $60,000 demand for compensation over his brother’s death remains unresolved.
“We have been waiting for justice for nearly a year, but the situation remains unchanged,” he said. “Until now we have not even received one cent in compensation.”
Mr Samrith said his family received about $100,000 from donations by the government and well-wishers.
Authorities have said the Chinese-owned building was built without a permit and the builders ignored stop-work orders from local officials who went down to the site a few times.
Four people involved in the collapse were arrested and charged.
They are Chen Kun, a Chinese national who leased the land for construction, Deng Xing Gui, a building contractor, Gao Yu, a concrete wall contractor and Nhek Huy, a Cambodian who owned the land.
Preah Sihanouk provincial court officials could not be reached for comment yesterday but Sreng Vanly, provincial coordinator for rights group Licadho who monitors the case said, the court has not fixed a trial date for the case so far.
He urged the court to speed up the case and provide justice to the victims.

Many of those who died were families living on the building site.

Six face trial in Sihanoukville building collapse

The Preah Sihanouk Provincial Court on June 25 and 26 tried four Chinese nationals, and one Vietnamese and Cambodian who were involved in a building collapse in Preah Sihanouk Province that killed 28 and injured 26 on June 22 last year.
Preah Sihanouk Provincial Court spokesman Lim Bun Heng said the trial lasted one and a half days, and a verdict is due in July.
“The court finished the hearing and will announce the verdict on July 22,” Bun Heng said, declining to comment further.
Six people were charged in the days after the deadly incident, among them four Chinese nationals, who have been awaiting trial in provincial prison, and one Cambodian and one Vietnamese national, who are on the run and will be tried in absentia.
Two of the Chinese nationals, the building owner Cheng Kun and the construction supervisor Deng Xing Gui, have been charged with manslaughter and causing unintentional injury and damage, and the other four men were charged with similar offenses.
Puth Theavy, a lawyer for Deng Xing Gui, 49, said the court had charged his client with two counts, unintentional killing and unintentional injury by the court.
“My client accepts his mistakes related with the unintentional killing and unintentional injury charges,” Theavy said, adding that according to the law, the charges carry a term of one to two years in jail.
“I request the court sentence my client to time served since he was arrested because my client has been imprisoned for more than one year already,” Theavy said.
“My client does not have the ability to pay the compensation for all the victims because my client does not have money,” Theavy said, adding that the victims had received a large amount of monetary support from the government.
Last year, the victims received more than $10,000 each in support from the government and according to their lawyers are now asking for $20,000 to $30,000 each in compensation from the defendants.
