Work Permit no longer required for business owners?

Post by Jack.R. »

I have been speaking with a few Chinese business man and agents they are adamant saying that if you own a business WP is not required. I was of the understanding that WP is necessary for a business owner that wants to stay on a EB visa. Did I misunderstand the law or something changed?

No, nothing has changed...Business owners are required to be in possession of a valid WP.

Why not...they're already being granted citizenship so that they can buy up property/land.

As long as they keep their friendly neighborhood Oknya's rice bowls flush with cash...most Chunks will be allowed to operate under flexible requirements.

You need a WP if you work. If you only are a owner / investor but do not work, you do not need a work permit. This is why it is called WORK permit.

It's called work PERMIT because it PERMITS you to WORK and it's a EB type visa REQUIREMENT to have WORK because the EB type visa is for those who WORK and those who do not WORK should be on ANOTHER visa type. You can own a business on any visa type you like. To be on EB visa which is for WORK you need a paper called WORK PERMIT and another thing called WORK.

I note different countries have different visas. Perhaps each country has different conditions regarding administrivia.

Just double checked and all the Chinese business man working in the SEZ I met today (7) had their business visa granted or renewed without anyone having a WP, they all own businesses here. Is it just that the process allows for it so they do it this way even if is it incorrect? Yet the fact that their businesses license and visa keep being renewed without an itch is weird.

FLB is right. Some countries like China, South Korea and Japan have a choice of different visas available for doing business that we don''t have access to , and different rules apply. I have also seen an Israeli passport with a ten year visa. I never knew what that was about. There are a lot of visa possibilities out there that we're not aware of, because we're not eligible and it does not concern us.
