Belgian sentenced to life over Brazilian cocaine

Phnom Penh Municipal Court today re-sentenced a Belgian man who was sentenced to life in prison in absentia in June for trafficking more than one kilogram of cocaine from Brazil to Cambodia through Phnom Penh International Airport in January.

Tanguy J. Taller, 36, a tourist convicted of drug trafficking together with accomplice David Catry Noel, 37, also a Belgian tourist, was again sentenced to life in prison today after requesting a retrial.

Judge Chhoem Rithy said Mr Taller was convicted of transporting drugs and trafficking, noting that Mr Taller was arrested on October 4 at the Cambodia-Vietnam International Checkpoint in Svay Rieng province’s Bavet city, after which he requested a retrial while in prison.

“Although the accused has denied the allegation and said that he was not involved, he did not prove to the court that he’s innocent,” Judge Rithy said. “Based on real evidence, the court will upholds the June 22 sentence and finds him guilty and sentences him to life in prison.”

Mr Taller, who was present in court yesterday, broke down in tears after hearing his sentence.

He said the judgement was unfair and again denied the allegations, adding that he will file an appeal with the Appeal Court.

I had the same thought but now he's sentenced again. Something must have gone wrong or they really wanted him in there. Life is a long time.

20 December 2018: The verdicts of two Belgian nationals were confirmed by the Phnom Penh Municipal Court on the morning of December 19, 2018.
The men, TANGUY EDDIE J TALLER, 37 and DAVID NOEL CATRY, 34, are both sentenced to life in prison and a payment of 80 million riel (US$20,000) to the state, for trafficking more than 1 kilo of cocaine from Brazil to Cambodia.

Does life mean life (unless a Kings pardon is granted) in Cambodia, unlike the west where life is 20 years or so, well in France and UK it is?

On another thread, the child protection officer from CPU said that "in Cambodia, life means life", so I guess he should know. But, yes, there is always possibility of a pardon, another appeal, or a release for "health reasons" or something similar. It's hard to know how many foreigners are released quietly for one reason or another, because obviously, it' s done on the quiet - don't think I have to spell out how that works ?

Belgian drug convict seeks vindication in Appeal Court
A Belgian national sentenced to life in prison for being involved in the trafficking of more than one kilogramme of cocaine from Brazil in 2018 is appealing to have his conviction overturned after claiming innocence.

Judge Seng Sivutha identified the Belgian national as Eddie J Taller Tanguy, 36.

Phnom Penh Municipal Court found Tanguy guilty of “drug transporting and trafficking” under Article 40 of the Law on the Control of Drugs in absentia in 2018 and sentenced him to life in prison.

The Phnom Penh court ruled Tanguy was connected to David Catry, owner of a restaurant in the capital, who was sentenced to life in prison after he was arrested with one kilogramme of cocaine at Phnom Penh International Airport in January 2018.

A court clerk during the hearing yesterday read out Catry’s testimony against Tanguy.

The clerk said Tanguy hired Catry for $30,000 to transport the drugs from Brazil, to be given to an unnamed Nigerian national in the Kingdom.

“Tanguy promised to pay me $30,000 to transport the drugs that were seized after the work was done,” Catry said, as quoted by the clerk. “Tanguy arranged the travels and paid for flights, food, transportation and accommodation.”

Appeal Court upholds a Belgian’s life sentence for drug trafficking

The Appeal Court today upheld the conviction of a Belgian man sentenced to life imprisonment over transporting more than one kilo of cocaine from Brazil to Cambodia in 2018.

Presiding judge Seng Sivutha identified the convict as Tanguy Eddie J. Taller, 36, a freelance designer.
Mr Sivutha said that Tanguy was charged with “drug transport and trafficking” under article 40 of Cambodian Law on Drug Control. He was apprehended on October 4, 2018.

“Based on the trial on March 24 and evidences, the drug belonged to Tanguy Eddie J. Taller,” Mr Sivutha said.
“Therefore, the Judges’ council of Appeal Court decided to uphold the Phnom Penh Municipal Court’s decision dated on December 19, 2018 as effective,” he said

Judge Sivutha said that Tanguy was sentenced to life imprisonment by the Phnom Penh Municipal Court in 2018.

He then appealed to the Appeal Court to have his conviction overturned.

I dont think its correct that the country turns them into bums and losers. I reckon they arrive with those qualities, possibly dormant in their systems, and the relatively lawless environment, cheap alcohol and easy access to drugs just brings it out. If it is in a mans nature to be a total no hoper, he will become in the right situation. By the same token a beautiful friendly environment like KOW can bring out some fine qualities in most of us, including caring for fellow man. And women. Just not the bums.
