That may be the case re the birth certificate, but withholding the mother's access to see the child so as to pressure/hurry her along is not a smart thing to do. As another poster said ppl don't respond well to threats. And a court will take a dim view of such action. You can't connect the two..getting the BC is one thing and the mother's access to the child is another.leeellis2406 wrote: ↑Mon Sep 24, 2018 2:08 pm I blame her for not making his birth certificate, she always dragged her feet on the subject and even though I had all my papers ready she never seemed to bother. Now it gives me the problem and headaches to sort all of this mess out.
You also said this: 'My son has lived with me for the last year and I gave access to his mother to visit every month with no problems. Now she decides to kidnap him'
Whilst the child has lived full time with you the past year, the mother nevertheless has the right of access. Sorry, but 'giving her access' sounds pompous to me..

No win semantics situation. Granting.visitation rights sounds like a jail term.

I get a sense that if you locate the mother and her son, you do not intend to involve the legal authorities in taking custody.
I think you should involve them now, let them do the searching, and let them process the situation legally and to the benefit of the child.

what do you have to prove ur the real dad?
did u do a dna test?
Just cause u took care of him for months.even a year does not mean much UNTIL you get to a court.. As it stands, u do not have any kind of a legal leg to stand on.
Go to the grand parents,( do u get along?)
I disagree with others here and suggest you DONT involve police/lawyers YET
First; Find her, try and talk with her as an adult. Eat CROW
See if u can come to arrangement.
In a nation run by swine, all pigs are upward-mobile and the rest of us are fucked until we can put our acts together: not necessarily to win, but mainly to keep from losing completely. HST

Agree with phuketrichard, what is the point of going legal when there is nothing legal in place? At least not now..
Negotiate something direct with her family has gotta be the best plan A at this point.

I was going to edit my post, as it sounds a bit harsh.
I do feel for the OP, but I think any agreement needs to be made legally, witnessed, and official.
If the intention is to grab the kid, or pressure the mother to give him up, things will be made much worse.
The mother may well have "seen sense" originally, but clearly either didn't really agree with situation, or changed her mind since.

is it sure that it's a idea of the mother ? or does the uncle perhaps needs money and the mothe doesn't know about the Kidnapping ?
Whatever, the only way is to go see the parents of her, witch will know where the daughter is or have a telefon number.
And the solution have to be a done BC and a court decision for you, as the only legal "parent" (I don't know the word in English). Witout this document, you can't do a passport for him or travel or do anything. We have the same Problem with the son of my wife. Without the father agrement, we can't travel with the boy. so we go to court and have now a paper, that say, that the father is missing and the mother the only responsible for him. But for that, you also Need a BC.
If the mother take the children and don't want money, just miss him, the thing will be much more difficult to solve. But the time is on your side......many 100 $ have to be given to the grandparents to take care of the child. Perhaps one day, she 'll come on the idea, that it's better that the boy live with his father.
Without knowing why the Boy was kidnapped (money, Feelings or just a uncle without money), it's difficult to say, what will be the best way to solve the Problem.

OP, you're in need for a serious reality check.leeellis2406 wrote: ↑Mon Sep 24, 2018 2:08 pm yes I need to get legal advice for sure. First thing is to locate him so I have a case to fight with her. I blame her for not making his birth certificate, she always dragged her feet on the subject and even though I had all my papers ready she never seemed to bother. Now it gives me the problem and headaches to sort all of this mess out.
You're on the wrong road and you might end up spending more time than you like in a police station or worse if you continue. If you locate the kid and take it your ex' family might break all contacts with you and simply take the kid back - rightfully so.
You claim to have a son, but you have absolutely no documents to prove it. This simply means you have to suck up the fact you have no rights at the moment, at all. Simply none. Zero. Nil. The fact your ex has never prepared those documents is no excuse for kidnapping a child, at least not according to the law.
But, you're lucky this is Cambodia. And in Cambodia money talks. Don't go after your son now and kidnap the kid. Her family knows where you are (from what I understand) and there's no chance you can legally leave the country with the kid. Negotiation and money is the way to go. If you can not talk to your ex/her parents by yourself, send someone on your behalf, and offer her money to support her life in exchange for you taking care of the kid. Just make sure the person visiting her / them says it sweeter than I just did. And her parents are a good start. If you have them on your side (whether it's because of the money or else) you stand a lot stronger.
And if you can not afford that.... Well..... Then you're fucked and you can go down the long legal road which might end with you getting the right to see your son once in a while.
But doing what you're doing now. Stop posting pictures of the boy, those will be on the web forever!
Going after the is useless, it will make your situation worse, and will make you feel stressed out when you need to get your act together to solve this matter.

I understand what you're saying. But I have been his legal guardian for the last 8 months with many witnesses. It will have to go to court I know but I have a good case and just want to find him so the police/authorities can take it from there. She's the bad person here and all I want is what's best for my son. Let the courts decide and then is legal yes? First things first is to locate him so I can let the authorities know of his whereabouts. I really don't want to be arrested for kidnapping him back as I am the principal of a school and have a lot to lose.

Sweet talk her into making a birth certificate with your name on it. Tell her she has the boy now make the paper. Save the fight to get him back until later.
