Former opposition party leader freed in Cambodia

PHNOM PENH, Cambodia (AP) — The leader of Cambodia's now dissolved opposition party was released on bail Monday after being jailed for a year on a treason charge, a government spokesman said.

Kem Sokha was arrested last September on the basis of years-old videos showing him at a seminar where he spoke about receiving advice from U.S. pro-democracy groups. His opposition Cambodia National Rescue Party denied the treason allegation, calling it politically motivated.

Another court last November dissolved the opposition party, saying it was plotting with U.S. assistance to overthrow the government of Prime Minister HE, who has led the country for decades. With no credible opposition, HE and his party won July elections to extend his stay in power, in a vote seen by much of the international community as unfair.

Phay Siphan, a government spokesman, said the Phnom Penh Municipal Court released Kem Sokha on Monday as requested by his lawyers. He did not provide details.

On Aug. 30, a court extended Kem Sokha's pre-trial detention by six months. Cambodia's courts are considered to be heavily politicized and under the influence of HE's ruling party.

Last week there were hopes among Kem Sokha's supporters that he might be released because in the past two weeks more than 20 people imprisoned for political activities have been freed with pardons or on bail.

On August 29, HE said publicly that Kem Sokha would not be released and would not receive a pardon because he has not yet been convicted.

Phnom Penh (FN), Nov. 10 – Phnom Penh Municipal Court decided to give more freedom to president of former Cambodian National Rescue Party (CNRP) Kem Sokha, according to the press release dated 10 November 2019.

The court said it continues to put Kem Sokha under judicial control with the following obligations: (a) must not leave the border of the Kingdom of Cambodia; (b) must not engage in political activities; (c) must respond to the summons of authority.

It is worth recalling that Kem Sokha was arrested in his house in Toul Kork district, Phnom Penh city at midnight of 3 September 2017, following a leaked video with his confession that he has implemented the order of the United States, by attempting color revolution following the model of former Yugoslavia and Serbia.

The Royal Government of Cambodia has accused Kem Sokha of committing “treason", conspiring with foreigners in the purpose to topple the legitimate government.

Kem Sokha was sent to jail in Tropan Plong Prison, Tbong Khmum province.

Following a one-year pre-trial detention, Sokha was released on bail and put under judicial control by not allowing to leave border of street 313, street 311, and street 608; nor meet former leaders of CNRP; nor engage in any political activities.

PHNOM PENH (Reuters) - Cambodia lifted house arrest restrictions on opposition leader Kem Sokha on Sunday, more than two years after he was charged with treason, but the charges remain and he is banned from politics and from leaving the country.

Pressure has been growing on HE, Cambodia’s authoritarian ruler of more than three decades, to ease a crackdown on his opponents as the European Union considers whether to cut preferential trade terms.

“As an innocent person who has been jailed for two years, I continue to demand that the charges against me be dropped,” Kem Sokha said in a Facebook post.

“I expect today’s decision to be the first step, but I, as well as many other Cambodians who have lost political freedom, still need real solutions and justice.”

Kem Sokha, 66, was arrested in 2017 and the Cambodia National Rescue Party (CNRP) was banned in the run-up to last year’s general election that HE’s ruling party then swept but which was condemned as a farce by Western countries.

Kem Sokha was accused of plotting with foreigners to oust HE - a charge he dismissed as nonsense.

The Phnom Penh Municipal Court said in a statement that Kem Sokha could leave his house, but that he could not engage in political activity or leave the country.

Cambodian Court Ends Probe of Treason Charges Against Opposition Leader Kem Sokha

A judge in Cambodia has ended a probe into charges of treason against opposition chief Kem Sokha, heralding what could be the conclusion of his two-year old case, days after the European Union issued a damning report saying the country had failed to make the necessary improvements to its rights record to avoid the loss of a crucial trade arrangement.

In a letter sent on Friday to the lawyer of Kem Sokha, the former president of the Cambodia National Rescue Party (CNRP), investigating judge Ky Rithy of the Phnom Penh Municipal Court said he had “decided to close the investigation,” without providing further details, including if or when the case will go to trial.

Kem Sokha’s lawyer, Peng Heng, told RFA’s Khmer Service that he and the rest of the CNRP leader’s legal team will meet to discuss next steps, but vowed to continue pressing the court to drop the charges against his client, who faces up to 30 years in prison if convicted.

“We have the right to request that the judge drop the charges before the final verdict,” he said.

Kem Sokha’s daughter Kem Monovithya, who is the CNRP’s deputy director-general of public affairs, tweeted Friday that the judge’s letter means that “either the prosecutor drops the charges or takes the case to trial,” adding that she and her father’s supporters “demand that all charges be dropped.”
