Re: Khmer Citizenship
Interesting question. It's all very well saying "if one is married one can trust one's wife", but marriages don't always work out so smoothly. I'm wondering if it's possible to leave property to your kid who may not yet be 16 or will it automatically go to their mother.taabarang wrote: ↑Thu Aug 16, 2018 8:15 pmCould a last will and testament stipulating other Cambodian family members override the right of inheritance to the son?PSD-Kiwi wrote: ↑Thu Aug 16, 2018 1:01 pmOne thing worth considering though...if married and there is property involved, if the Cambodian wife/husband dies, the foreigner cannot inherit the property...if they have children together who are over 16 then they can inherit the property, but if under 16 they cannot as they cannot legally own property.armchairlawyer wrote: ↑Thu Aug 16, 2018 12:41 pm As for owning land, ... if one is married one can trust one's wife (I mean if one is committed enough to think about citizenship then this is realistic).
(I could go into more detail, but this has been discussed in another thread, will try to find the thread)
Silence, exile, and cunning.
Re: Khmer Citizenship
Is there such a thing as a trust fund, with kids as beneficiaries?
That social phenomena appears to already exist in Cambodian society, but I'm guessing the finances are more opaque.
Can a trust own property?

Yes, a will leaving it to other family members is an option, but it would definitely want to be a family member you trust 110%.taabarang wrote: ↑Thu Aug 16, 2018 8:15 pmCould a last will and testament stipulating other Cambodian family members override the right of inheritance to the son?PSD-Kiwi wrote: ↑Thu Aug 16, 2018 1:01 pm One thing worth considering though...if married and there is property involved, if the Cambodian wife/husband dies, the foreigner cannot inherit the property...if they have children together who are over 16 then they can inherit the property, but if under 16 they cannot as they cannot legally own property.
Another option is placing the property into a trust for the children, however trying to obtain any decent, reliable information in regards to Trusts in Cambodia is proving difficult...unless you pay a lawyer.
Re: Khmer Citizenship
I'm trying to find the thread where all of this stuff regarding property inheritance and trusts, etc was discussed...must have been on K440.

IN Thailand a child with an id card, can own property, ( given them via a will) BUT can not sell said property until they come of age, 18 and the farang dad can be the guardian.
also in the case of a wife dies and her husband is a farang, he has 6 months to sell or transfer the ownership to a thai
seems u stated on the other thread in Cambodia its 3 months he has to sell it or transfer it
and we went back and forth on the issue

Re: Khmer Citizenship
Talking about if the Cambodian husband/wife dies...so obviously the foreigner widower would care!
And we are discussing Cambodia...NOT Thailand
Yes, in Cambodia, foreigner has 3 months to sell.
