Contracts in Cambodia-Loan contract

Hi everyone,

I wonder if you could fill me in on your knowledge re contracts in Cambodia. I want to make a contract for providing a loan to someone. I know that in order for the contract to be official, it needs to be in Khmer, it needs to say Nation, Religion, King on top. I seem to remember it need to be witnessed by someone and signed or thumbprinted by both parties.

Anything else I should be aware of? Again the purpose of this contract is to record that a loan is being made to someone and that they agree to pay it back on such and such a date, etc.

doesnt matter what ur header is lol, most important thing to remember, as this is a personal loan n u do not hv a license to give loan, ur only recourse is to sue the other party in a civil suit, thus ur contract has to be endorsed by either sangkat, commune or nearest police, hope this help

The loan interest must not exceed 18% per annum.

I have often been asked to thumbprint a document and then sign on top of the thumbprint thus rendering both forms of ID useless. I just shake my head and comply.

not applicable, unless you are a licensed moneylender

usually u sign and stamp below the thumbprint, the guy must hv depth perception issues
