Koh Rong families fear losing their land

About 40 families in Sihanoukville’s Koh Rong commune who fear losing their land have requested intervention from provincial authorities in order to stop the activities of tycoon Sok Bun and officials from the Ministry of Land Management.

A letter, which bears the thumbprints of 42 families living in Koh Rong commune’s Prek Svay village and was submitted to Preah Sihanouk provincial hall on Monday, stated that they have lived in the area since the Sihanouk regime.

It said they have lived there planting crops for a living with land ownership documents recognised by both village and commune authorities.

However, last week Mr Bun and a working group from the Land Management Ministry went to take measurements on their land, the letter added.

The letter said the land measurements concerned residents as Mr Bun claimed to own up to 525 hectares of land on which the 42 families lived.

“The action of Sok Bun and his accomplices, who went to measure without the local authorities and the landowners knowing in advance, is completely illegal and impacts our rights and interests badly,” the letter said. “So, we ask the provincial governor to help prevent those people from coming onto our land from now on.”

The government has decided to reallocate more than 520 hectares of land in Sihanoukville’s Koh Rong and Koh Rong Sanloem communes from state land to private ownership for nearly 300 families living there.

According to a sub-decree issued on Wednesday, the government decided to provide 528.37 hectares of land in the two communes to 298 families living in the area, while also allocating some plots of land for schools, administration offices, commune halls, village headquarters, military units and pagodas.

Late last month, 42 families in Kong Rong commune submitted a request to Preah Sihanouk provincial authorities to intervene to stop the activity of tycoon Sok Bun and Land Management Ministry officials, who went to measure their land. Koh Rong commune chief Seng Hour Leang said yesterday that of the 298 families receiving land titles, some were from the 42 families that had a land dispute with Mr Bun.

PM orders minister to end land dispute
Prime Minister HE yesterday ordered the Minister of Land Management to check on and handle more than 580 land plots for citizens properly to end a land dispute on Koh Rong in Preah Sihanouk province.

Meanwhile, Koh Rong commune authorities yesterday prohibited some people who have not yet received land titles from participating in an event the premier was attending on the island.

During the inauguration of The Royal Sands Koh Rong resort in Koh Rong commune’s Sok San village, Mr HE said the government recently issued a sub-decree to resolve the land dispute by issuing 1,221 land plots.

The government has already handed out more than 637 land plots equivalent to 525.37 hectares to 294 families that live permanently on the island.

Mr HE said the remaining 584 land plots had not been resolved yet because some land plots were in dispute since some residents did not live on Koh Rong, but conspired with each other to grab land on the island.

Disgraced tycoon faces fraud charges

Disgraced tycoon Sok Bun, four commune officials and a village chief have been arrested and charged on multiple counts in relation to the alleged forging of documents to acquire 500ha of community land on Koh Rong, an island off Preah Sihanouk province.

Deputy Prosecutor Kuch Kimlong told The Post on Monday that six people had been forwarded from the Anti-Corruption Unit (ACU) on Monday to Phnom Penh Municipal Court in relation to a land dispute in Preah Sihanouk province’s Koh Rong town.

The six were Bun, president of the Sokbun Group, Koh Rong commune councillor Ung Nith, Koh Rong commune chief Seng Huorleang, Koh Rong second deputy chief Keo Som, Koh Rong commune councillor Hem Sa Les and Prek Svay village chief Keo Pov.

Prosecutor Kimlong said Bun had been charged with forging public documents, using forged public documents, instigating intentional destruction and embezzlement under articles 629, 630, 601 and 28 of the Criminal Code.

Nith was charged with intentional destruction and embezzlement, misappropriation of public funds, forging public documents and the use of forged public documents, he said.

The four others, Huorleang, Sa Les, Som and Pov, were charged with intentional destruction and embezzlement, forging public documents and using forged public documents.

Villagers interviewed by The Post last month said Bun had used land titles in an attempt to request ownership approval for 500ha he said he had bought from a villager.

However, local authorities said Bun’s documents appeared suspicious and rejected his request for approval.

Phnom Penh, Cambodia News: On June 28, 2019 at 2:53 pm, the Supreme Court upheld the arrest of six suspects in connection with fake land sale documents and use of public papers. The suspects are ordered to remain in detention.

Sok Bun, 41, was charged with falsifying public documents and using fake public documents with intent to defraud. Abuses were committed from 2016 to 2019 under the provisions of Articles 629, 630 and 28 (601) of the Criminal Code.

ACU reveals probe on tycoon over land grab bid

ACU chairman Om Yentieng said the unit had spent five weeks on investigating and collecting evidence before it decided to arrest tycoon Sok Bun and five commune officials regarding a land grab bid in Preah Sihanouk province’s Koh Rong city.

Speaking in a press conference today, Mr Yentieng explained that the probe ACU had carried out was over a serious land encroachment complaint in Koh Rong city, noting that Mr Bun and his companions forged public documents.

“It was an attempted conspiracy between Mr Bun and five commune officials to grab land by bringing documents for local authorities to sign in order to transfer the ownership,” he said. “These people created fake documents.”

Mr Yentieng noted that after ACU received the complaints on this case, it had spent five weeks on investigations before it decided to arrest and question them for three days.

“This case involves state and private land and in the complaints, they were accused of intentional destruction of property and abuse of power,” he said.

Mr Yentieng said it was an achievement for ACU in its investigation because strong evidences have been found.

“We have discovered many fake documents. The five commune officials also confessed to their wrongful acts. This is a successful investigation,” he said.

Phnom Penh Municipal court has charged Mr Bun and the five officials with intentional destruction and embezzlement, forging public documents and using fake public documents earlier this week.

The offences were committed in Koh Rong commune from 2016 to 2019, in which they attempted to grab about 500 hectares of land that belong to 42 families in Prey Svay Village.

Tycoon jailed for seven years over land grab bid

Phnom Penh Municipal Court today convicted and jailed tycoon Sok Bun, Cambodian Valuers and Estate Agent Association president, for seven years over a land grab bid in Preah Sihanouk province’s Koh Rong city committed between 2016 and 2019.

The court also sentenced five former city and commune officials to between five and seven years each over the same offence.

Presiding Judge Seng Rithy identified the five as Ung Nith, the former Koh Rong city council chief, Seng Hour Leang, a former Koh Rong commune chief, Hem Sales, a former commune council member, Ke Sorm, a former deputy commune chief and Keo Pov, a former chief of the commune’s Prek Svay village.

Judge Rithy said Bun, Hour Leang, Sales, and Pov were convicted and sentenced to seven years in prison each while Sorm was jailed for six years and Ung Nith was sentenced to five years.

“The court has decided to convict and sentence the accused Sok Bun, Seng Hour Leang, Hem Sales, and Keo Pov to seven years in prison each and orders them to pay ten million riels [ about $2,500] each to put in the state’s budget as a fine,” Judge Rithy said in the verdict.

He added that they were arrested after they had forged the land documents and grabbed more than 500 hectares of state land and villagers’ properties located in Koh Rong committed from 2016 to 2019.
