BEIJING, March 2 (Xinhua) -- An application procedure for validating Chinese invention patents in Cambodia will be launched, an official said Friday.

Chinese invention patents granted by the State Intellectual Property Office (SIPO) since Jan. 22, 2003 will be eligible to take effect in Cambodia, said He Zhimin, vice director of SIPO at a press conference.

In September 2017, China and Cambodia signed a memorandum of understanding on intellectual property cooperation.

Chinese patent holders may skip patent review procedures and directly make application to Cambodia's Ministry of Industry and Handicrafts. Once approved, they will obtain patent rights, and their patents will be valid and protected for 20 years, similar as in China.

"The cooperation shows that China's patent system is recognized by Cambodia, which will pave the way for intellectual property cooperation between the two countries," He said. "It also provides a model for China's cooperation with other countries in the field of patent examination."

Chinese patent deal to come into effect this month
The validation agreement between China’s State Intellectual Property Office (Sipo) and Cambodia will enter into force by the end of this month, helping protect Chinese invention patents in the kingdom.

“The agreement will take effect on March 28. It will help us attract more Chinese investors into the kingdom,” said Phe Chantravuth, director of the department of industrial property at the Ministry of Industry and Handicraft.

The agreement was signed in September between Sipo’s Commissioner Shen Changyu and Cambodian Minister of Industry and Handicrafts Cham Prasidh.

This will be the fourth patent agreement that Cambodia has signed with a foreign nation, following similar deals with the European Union, Singapore and Japan.

Valid Chinese Invention Patents Can Be Validated in Cambodia by Registration

In September 2017, mainland China State Intellectual Property Office (SIPO) signed a Memorandum of Understanding on Intellectual Property Cooperation with the Senior Minister and Minister of Industry and Handicrafts of Cambodia, which confirmed that valid Chinese invention patents can be registered to become effective in Cambodia. This was a breaking achievement of the Belt and Road strategy in intellectual property cooperation. In March 2018, the SIPO announced that acceptance of application for effectuation of valid Chinese invention patents in Cambodia was officially initiated.

All invention patents applied after January 22, 2003 in China that have been approved by the SIPO and maintained valid till now are eligible to be validated in Cambodia. When filing an effectuation application for a valid invention patent, the applicant is required to submit an application Form, a copy of the patent specification and the patent registry certificate issued by the SIPO, as well as English and Cambodian translations of such documents, etc. After examination conducted by Cambodia Department of Industry and Handicrafts, the patent will be protected in Cambodia and have the same application date and term of protection as the corresponding Chinese patent. That is, a protection for 20 years starting from the date of application in mainland China.

Valid Chinese invention patents may become effective in Cambodia, which is different from other existing modes of sharing patent examination in the world, in that Cambodia directly recognizes the results of patent examination of China in a country-to-country, unilateral, retroactive, and more convenient way.

By direct recognition of the results of patent examinations, Chinese invention patentees can avoid lengthy substantial examination procedures, save application costs, and obtain patent rights and related protection in Cambodia quickly and conveniently. On the other hand, work efficiency can be boosted dramatically and examination costs can be saved in Cambodia. This cooperation is a major step towards the promotion of "going out" of Chinese patents and patent examinations.

S. Korean Patents to be Recognized in Cambodia

A program, the first of its kind, will be introduced in Cambodia allowing patents registered in South Korea to have the same effect in the Southeast Asian nation.

Park Won-joo, commissioner of the Korean Intellectual Property Office, signed a memorandum of understanding(MOU) on this patent agreement with Cambodian Minister of Industry and Handicraft Cham Prasidh in Phnom Penh on Friday.

Under the program which is to take effect from November, patents registered in Korea can obtain the same validity in Cambodia within three months following a simple process of submitting a request for patent recognition and related documentation.

Around 30 South Korean patent applications were filed in Cambodia between 2010 and 2018 but due to limited resources, patent deliberations have been delayed and not a single case has been registered.

Once the new program is implemented, Korean firms planning to enter the Cambodian market will be able to swiftly acquire patent rights and thereby gain better understanding in predicting local business conditions.

The Korean Intellectual Property Office also on Thursday signed an MOU with Cambodia's vice commerce minister on cooperation in various fields covering intellectual property rights, trademarks and digitization.
