Date of Kem Sokha trial

Post by taabarang »

Does anyone know if a date has been set? I ask because there are govt. plans to not allow people from the provinces to enter PP on that date. This edict has been enacted before, but police only quickly scanned the passengers in a bus. For more details see :

Kem Sokha has been summoned to appear before the court hearing on the dissolution of the CNRP.
“The presiding judge summons CNRP’s president…to participate in the trial on November 16, 2017 at 8am at the Supreme Court over the complaint to dissolve CNRP,” reads the summons, which is dated October 27.

Sokha’s lawyers have previously stated that he will not submit any evidence to the court in the case, as he considers the trial a “political game”.

One of Sokha’s lawyers, Peng Heng, confirmed today the legal team had received the summons, but said he didn’t know if Sokha would stand by his previous decision not to submit evidence.

It's today, but Sokha won't be there. The trial date was kept quiet for obvious reasons.

Phnom Penh puts police on high alert ahead of Sokha’s high court hearing
Tue, 31 October 2017

Phnom Penh Governor Khoung Sreng yesterday directed all security personnel to prevent any opposition supporters from observing or protesting CNRP President Kem Sokha’s Supreme Court hearing today regarding his detention on “treason” charges.

Once again, however, the jailed opposition leader will not be present at a hearing related to his detention, according to Justice Ministry spokesman Chin Malin. An Appeal Court hearing last month took place without Sokha in court. Malin again cited security reasons as the justification for his absence today.
Sreng’s directive comes two weeks after Interior Minister Sar Kheng instructed provincial officials to prevent people from entering the capital and attempting to protest Sokha’s detention.

Coinciding with Sreng’s directive, increased security personnel – including police, Military Police and members of Prime Minister HE’s personal Bodyguard Unit – could be seen across Chamkarmon and Daun Penh districts in the city yesterday, with armed officers at many street corners.
Touch Narith, a deputy National Police chief, said the security arrangements were in place for the upcoming Water Festival, set to begin on Thursday, but Chhon Kaony, Chey Chumneas commune police chief, said it was also in anticipation of Sokha’s hearing...

No trial. No bail. Sokha will be maintained in pre-trial detention.

Court upholds Sokha detention for ‘treason’
1 November 2017
PHNOM PENH - Sokha was arrested in a midnight raid on his Phnom Penh residence on September 3 after a 2013 video surfaced in which he said international assistance had played a role in his political rise. The Phnom Penh Municipal Court remanded him to pre-trial detention, a decision that was upheld by the Appeal Court in late September.

Security forces were deployed throughout the city yesterday, with streets leading to the Supreme Court barricaded, preventing several dozen supporters and spectators, and a handful of CNRP lawmakers, from reaching the premises.

After a two-hour deliberation, presiding Judge Khem Pun said he could not find any legal fault with the decision to keep Sokha in prison.
“The decision of the Appeal Court is legally correct,” he said.

Kem Sokha to Appear at Appeal Court Tomorrow
26/03/18 13:30

Phnom Penh (FN), March 26 – Former President of Cambodia National Rescue Party (CNRP), Kem Sokha, will appear at the Appeal Court on Tuesday morning for the second time, according to Kem Sokha’s Facebook page on Monday.

Sam Sokong, a Lawyer of Kem Sokha, confirmed that Kem Sokha filed a complaint against the Phnom Penh Municipal Court's decision to extend the detention of Kem Sokha for six months following a hearing on bail.

Kem Sokha was arrested at his house at 00:35 am on September 3, 2017 by justice police in his house located in Toul Kok, Phnom Penh. The arrest was made when Sokha appeared in a video to initiate plans to topple the government. He is facing a penalty of 15 to 30 years in prison based on article 443 of the Criminal Code.

Cambodia’s opposition leader Kem Sokha denied bail despite flurry of jail releases
22 Aug 2018 02:25PM
PHNOM PENH: Cambodian opposition leader Kem Sokha was denied bail on appeal on Wednesday (Aug 22), despite a string of high-profile figures being shown leniency by authorities in the aftermath of the country’s general elections.

Sokha has been imprisoned since September last year and continues to await trial on treason charges, stemming from a speech he made in Australia in 2013. His pre-trial detention had last been extended by six months in March.

He and his party - the Cambodia National Rescue Party - were forcibly dissolved ahead of the national vote, in a move widely considered politically motivated.

In the opposition’s absence, the ruling Cambodian People’s Party won every seat in the National Assembly.

The 65-year-old has been in poor health while being held in an isolated prison near the Vietnam border.

His lawyer called on the court to consider Sokha’s urgent need for overseas medical treatment. He was not present in court.

“We are very sorry that the court didn’t decide in favour of our client,” Sokha’s lawyer Pheng Heng said outside the court, adding that he feared his condition could worsen.

In the days leading up to Sokha’s case, Council of Ministers spokesman Phay Siphan had dismissed the appeal as fanciful.

However, there was still a sense that Sokha could be given respite amid a softened climate for opponents of the government in recent days.
