Australian boyfriend to be charged for murder after death of girlfriend in jet ski accident

Thai police charged an Australian man on Thursday with recklessly causing the death of his girlfriend when two jet ski they were riding on smashed into each other.
Emily Jayne Collie, a 20-year-old Australian, died Sunday in a horrific collision off the coast of Phuket island.

Her boyfriend Thomas Keating, also in his twenties, was on the other jetski.On Thursday police charged Keating under Section 291 of Thailand’s criminal code.He was formally charged this morning with reckless action that results in the death of another person,” Colonel Sanya Thongsawad, commander of Karon Police station in Phuket, told AFP. Police are questioning him this afternoon to see whether he will confess or deny the charge,” he added.

Keating faces up to 10 years in jail if convicted although a confession could result in a suspended sentence, Sanya said.

The decision by Thai police to charge Keating comes after Collie’s parents said they did not blame him for their daughter’s death. “This was a tragic accident. We do not believe anyone was at fault. In particular, we do not place any blame on Tom Keating, who we care about very much and we know loved Emily deeply,” the parents said in a statement released through the Department of Foreign Affairs and Trade, according to Australian media.

Australian media said Keating may not have seen his girlfriend’s jetski because of strong sunlight reflecting off the sea.

But investigators said the couple were driving dangerously before the collision.
“It seems that they were having too much fun, driving in a zigzag to splash water at each other,” Sanya told AFP, noting the jetskis both suffered damage to their left flanks, which suggested a near head-on collision...

If it has actually reappeared then he's finally got the licence/paperwork to operate it. The reason it periodically turns up over the last two years is that the first time he had no papers, he then got a permit, it turned out to be fake, presumably he's reapplied and got a real one now. He brought it from Thailand. I've no idea how he makes any money, that place still stinks of shit even though they've capped the sewer next to it. Japanese guy. Sushi was ok, nothing special. The Italian guy who had that place before paid $40k, never made any money, gave it to his girlfriend when his wife insisted he go back, she couldn't arsed with it so it went back to the landlord for 2k. I'm guessing this guy paid a similar price as the Italian.

Mr Keating was formally charged at Karon Police Station yesterday, with strong support from his family as well as from the family of Ms Collie. (See story here.)

“During the seven hours while investigators questioned him, he accepted a plea of guilty,” Karon Police Chief Col Sanya Thongsawad confirmed to The Phuket News this morning (Feb 10).

“In his statement to police, he explained that on Sunday Feb 5, 2017 he and his girlfriend rented jet-skis at Karon Beach,” Col Sanya said.

“A big wave surged while they were zigzagging, causing the two jet-skis to collide,” he explained.

“Mr Keating was very sad while recounting all this to the investigators,” Col Sanya said.

Explaining the seven hours taken to question Mr Keating, Col Sanya said, “When we were first questioning him with his lawyer, he rejected the charge. At 12:30pm, we took a two-hour break for lunch.

“He returned with his lawyer at 2:30pm and during the following three hours he accepted the charge,” Col Sanya said.

Col Sanya noted that the guilty plea is now very likely to expedite the case through court.

Despite reassurances from the police that a guilty plea would expedite his case, Keating has been told that the case will not be heard until 23 June.

Phuket court sets June date for Aussie tourist Keating’s trial
Mr Keating has already entered a plea of guilty to the court to the charge of reckless driving causing death for the jet-ski accident that killed his girlfriend of two years, Emily Collie, on Feb 17.

However, according to the Phuket Provincial Court public register, Mr Keating must present himself in court at 10am on Friday, June 23 to hear the verdict for or against him, The Phuket News learned today (Feb 24).

A court official explained to The Phuket News today (Feb 24) that although Mr Keating has entered a plea of guilty – the court will still have to receive the evidence against him and then hand down its verdict.

“Presently, Thomas Keating has been released on bail by the court, but his passport is being held by the court and he can’t go out of the Kingdom of Thailand during this time,” the court official said.

“Sorry, we cannot give more information,” the official added.

Melbourne man who accidentally killed his girlfriend in Thailand jet ski accident spared jail

At Phuket Provincial Court, a Thai judge on Thursday handed down a suspended sentence to 22-year-old Thomas Keating, who was found guilty of causing death by negligence.

He pleaded guilty and was sentenced to a year in jail, suspended for two years, and was also fined $185.

The charge specified that "the accused committed the crime without intent but also without care".

He had been barred from leaving Thailand pending the completion of his trial, but will now return home in coming days.
