Phnom Penh (FN), Aug. 2 - Following the nomination by the United Nations Secretary-General António Guterres, and the approval by the Supreme Council of the Magistracy, His Majesty the King Norodom Sihamoni has appointed Ms. Maureen Harding Clark (Ireland) as an international judge of the Supreme Court Chamber of the Extraordinary Chamber in the Courts of Cambodia (ECCC), according to the press release dated Friday.

Ms. Brenda J. HOLLIS (USA) has been appointed as the new International Co-Prosecutor in the Extraordinary Chambers in the Courts of Cambodia (ECCC) effective Sept. 1, 2019, said the ECCC in a press release dated today.
Her appointment was made by His Majesty Norodom Sihamoni, King of Cambodia, following the nomination by the United Nations Secretary-General Antonio Guterres, and the approval by the Supreme Council of the Magistracy, it pointed out.
Ms. Hollis replaces Mr. Nicholas Koumjian (USA) whose appointment ended in June this year, added the same source.
According to the press release, Ms. Hollis was appointed as the Reserve International Co-Prosecutor in 2015. She served as the Prosecutor of both the Residual Special Court for Sierra Leone (RSCSL) and the Special Court for Sierra Leone (SC SL) from February 2010 through August 2019, where she earlier also served as the Principal Trial Attorney responsible for leading the prosecution of former Liberian President Charles Taylor.

New Reserve International Co-Prosecutor of ECCC named
King Norodom Sihamoni has appointed Fergal Gaynor from Ireland as the new Reserve International Co-Prosecutor of the Extraordinary Chambers in the Courts of Cambodia (ECCC), said in a statement issued today.
The appointment was made upon nomination by the UN Secretary-General Antonio Guterres and the approval of the Supreme council of the Magistracy.
According to the ECCC, Mr Gaynor served as a Trial Attorney in the Office of the Prosecutor at the International Criminal Tribunal for Rwanda (ICTR) and the International Criminal Tribunal for the former Yugoslavia (ICTY) between 2005 and 2013 before serving as a Senior Assistant Prosecutor at the ECCC in 2015 and 2016.

Cambodia: Khmer Rouge Henchman Faces Death Behind Bars – OpEd

An application by the sole survivor of the Khmer Rouge leadership to disqualify the six appeal judges who sentenced him to life imprisonment twice, for genocide and crimes against humanity, has been dismissed by a special panel at the UN-backed tribunal.
It was a small but important milestone for the tribunal.
At 88, Khieu Samphan is now expected to die behind bars after being found guilty of crimes against humanity in Case 002/01 in 2014 and then genocide in Case 002/02 four years later alongside Nuon Chea, who served as Brother No.2 to Pol Pot. Nuon Chea died almost one year ago.
Their two separate life sentences were later merged by judges in the Extraordinary Chambers in the Courts of Cambodia (ECCC) who were charged by the UN with finding justice for two million people who perished under Khmer Rouge rule between April 1975 and January 1979.
Last October, Khieu Samphan’s defense lodged an application for disqualification, asking the Supreme Court Chamber to disqualify the six appeal judges who adjudicated in Case 002/01.
The ECCC said the special panel established the legal foundations governing the admissibility of an application for disqualification of a judge and unanimously found Khieu Samphan’s application for disqualification was admissible.
It also said that after reviewing all the criteria for disqualification, the special panel found that all judgments of Case 002/02 and 002/01 of the appeal judgment were impartial.
“The attempt to disqualify a judge is a standard arrow in the quiver of any defense attorney, and it is a maneuver that has been employed frequently at the ECCC,” said Craig Etcheson, the author of Extraordinary Justice: Law and Justice and the Khmer Rouge Tribunals.
“But it is no surprise that Khieu Samphan’s attempt failed, as have all previous such attempts at the Khmer Rouge tribunal,” he told UCA News.
It was Khieu Samphan’s last chance of freedom. His appeal for Case 002/02 is still ongoing and Etcheson added a decision on that was not expected until the fourth quarter of 2022.

Ao An dies in Battambang

In August, the Supreme Court Chamber of the UN-backed Khmer Rouge Tribunal “terminated” the case against An after thirteen years of investigation into charges of crimes against humanity.
An, known as “Ta An”, was a former Khmer Rouge deputy secretary of the Democratic Kampuchea regime’s Central Zone and Sector 41 secretary.
He was charged in 2015 with premeditated homicide and crimes against humanity. In 2016, he was charged with additional crimes, including genocide.
An allegedly committed various crimes against humanity in many areas and sites, including at Anlong Chrey Dam Forced Labour Site, Kok Ring Execution Site, Met Sop Security Centre as well as Tuol Beng and Wat Angkuonh Dei Security Centres.
