Just In: Trump Disqualified From 2024 Presidential Primary Ballot, Colorado Supreme Court Rules

Post by phuketrichard »

Donald Trump can’t appear on the 2024 presidential primary ballot in Colorado because of his actions surrounding the Jan. 6, 2021, riot at the U.S. Capitol, the state’s highest court ruled Tuesday.

The first-of-its kind decision sided with a group of Colorado voters who argued in a lawsuit that the Republican front-runner was disqualified under a clause in the 14th Amendment. Enacted after the Civil War, the provision disqualifies from public office those who swore to defend the Constitution and then “engaged in insurrection or rebellion” against the U.S.

“President Trump incited and encouraged the use of violence and lawless action to disrupt the peaceful transfer of power,” the Colorado Supreme Court said in a 4-to-3 ruling.
A spokesman for Trump called the ruling “completely flawed” and said the campaign would swiftly appeal to the U.S. Supreme Court.

If Colorado's Supreme Court's decision is appealed to the US Supreme Court, then you'd have the federal SCOTUS interpreting and ruling on a Colorado state law.

SCOTUS doesn't technically even have to accept the case. They could just boot it back to Colorado, which would kinda be like a tacit approval stamp.

But how likely does that seem?

Has President Trump ever been found guilty of engaging in insurrection or rebellion against the U.S.

I don't think so.

What is Biden and his Democrats so scared of?
They know Trump's got 2024 in the bag, so they have to stop him at all costs.

They sure seem to be doing a lot of dictatoring in their pursuit to block a dictator from being elected by the people.

not yet, but hopeful

My take,
Trumps supporters would vote for him even if he was in Jail< The more they go after him, the more his supporters love /admire him
so
Many dont like Biden, he has alienated the Arabic population/ blacks in America
so they wont vote cause the dems are sticking with him, which gives trump the win.
What is Biden and his Democrats so scared of?
everything, plus his love /admiration of Putin, Xi Jinping and Kim Jong Un
he wants be just like them and that is fucking scary for america

Come Jan 20th 2025 when trump is sworn in, the shit will hit the fan, pay backs a bitch

As a former Trump supporter, I really do not have a dog in this next fight. Having said that, I would like to see Trump get convicted and re-elected and then watch the system try to sort that out.

Why? The Colorado Supreme Court based its decision on its own interpretation of a clause of the 14th amendment of the US constitution.

The SCOTUS will want to weigh in on that interpretation, would be my guess. Sooner or later, this legal question will have to be decided upon. That Trump hasn't been tried and convicted for the crimes in question - at least not yet - might be a problem.

Good point, SCOTUS would want to weigh in on the 14th Amendment issue. I was erroneously thinking more of the state-specific voting statutes, regs etc (a la commandeering)

By attempting to block him from running they are making him look like the sane, responsible option. The fact that the Democrats only option is a man so old he doesn't know where he is half the time, supported a woman so unpopular they won't let her step up because she will guarantee a loss. What a shambles. America isn't even pretending anymore.
