From the sounds of things it's sounding more and more likely that the trigger for the escalation was a struggle for the officers gun which resulted in a shot fired while he was still sitting inside of his car

but it took 6 shots ( 4 to the arm as he could aim ) to bring him down and one to the top of his head ( the kill shot) Excessive force?

if the video of the store an him stealing cigars is true, would bet $$ to it was not his first time doing this.
