I suspect the fact that the dog is humping without being held, secured, tied up, etc. would be enough. It's a dog... they hump anything consensually...

So we immediately land right where we started. Female dogs don't hump. Let me rephrase. If a guy puts his penis into a dog's asshole, how do you prove in court whether it was consensual or not?

You can't and thus it's rape because you can't prove that it's not. Simple really. If the law was changed it might be the first time ever that women got a right in law that men didn't get first...

The burden of evidence lays on the prosecution in most countries. Let's turn the table. How does a prosecutor prove whether an animal was raped or was consensually engaging? The animal can't speak for itself so the accused will of course deny rape allegations.
Do you really think this is what the courts should be busy with? I personally think there are more important cases to handle. Beastiality's current legal status is, clearly, far less complex.

I must have missed the bit where animals consented to become human slaves. I must have missed their consent to be dressed up in clothes or left in tiny rooms all day long by their "caring" owners... we don't ask animals to consent to being food either. How is it that fucking an animal is worse than killing and eating it? I bet if you asked the animal if it would like to be on the shelf in Lucky or banging a chick, the chick would have a queue forming pretty rapidly outside of her home.
I appreciate that this is a "moral" question in many minds. It just seems ridiculous. Rape, murder, child abuse, enquiries often falter for the lack of funds but there's always time to arrest, process and prosecute people doing things that are relatively (if not completely) harmless in the scheme of things. Bestiality makes me cringe, it doesn't feel natural at all that someone would want to fuck another species, but... making me cringe is not a good reason to make things unlawful. If we did that Jeremy Clarkson, Russell Brand, and Katie Hopkins would all be looking at serving life sentences.
