You still don't get it? It doesn't fucking matter what anyone says. As this OP points out, the thai cops enforce or don't enforce the law when they feel like it, but it's still the fucking law. If what the idiot immigration commander said is true, the incident in the OP wouldn't have happened. It did happen. It does happen. It will contineue to happen when it suits their mood. You can waive your thaivisa article in their face if they stop you for your passport. i doubt it will do much good.

The rule has already passed , some one I met is banned for a year from January 4th 2016 for a 4 month overstay and this is from the horse's mouth not Thai visa or bkk post.

The new overstay rule was never in doubt here. The initial question was whether THE LAW states that foreigners need to carry their passports with them, and it does. It IS the law, and selective enforcement by Thai police doesn't change that fact. Some police may (or may not) let you get away with a carrying copies of the key pages, but that doesn't change the letter of the law.

I feel like I'm seeing this row in stereo... it's going on full blast on Thaivisa too. For me, it's simple - carry a passport or expect a night in the cells. That's the reality of what happens here in Thailand. The actual law is, as always in South East Asia, irrelevant to what happens or doesn't happen.

you will NOT be arrested; (jamie they will not follow you back to your room) LOL
you MIGHT be detained until someone can bring your passport to the police station, ( as what happened to the people in the article) and than will be let go, no charge, no fine
If you cant produce your passport than u will be arrested

No surprise here. This sort of harassment has become the new normal in the erstwhile "Land o' Smiles". Anti-farang sentiment will increase exponentially this year.
