No Verdict in Sovann Komar Child Abuse Case as Reinvestigation Ordered

The Phnom Penh Municipal Court on Wednesday announced it was sending back a Johnson & Johnson-linked orphanage’s child abuse case to an investigating judge.

Judge Ly Sok Leng announced the decision in an afternoon session, saying the renewed investigation would search for more information about the alleged victims as well as evidence to place additional charges against the accused.

Sothea Arun, the former director of Sovann Komar, an orphanage set up in Phnom Penh’s Chbar Ampov district by late Johnson & Johnson heiress Elizabeth Johnson, faced charges including torture, while three other defendants, caretakers Hun Chenda, Thay Sinuon and Ung Veasna Nimol, were on trial for intentional violence and other charges.

New management took over the orphanage in 2019, two years after Johnson’s death, and accused Arun of corruption and child abuse

Last month, a lawyer for Sovann Komar also accused the prime minister’s bodyguard unit chief Hing Bun Hieng of looking to grab the orphanage’s prime waterfront land, an allegation the general denied.

The plaintiffs’ lawyer, Tan Keattech, said on Wednesday that he had yet to receive details on the judge’s decision to reinvestigate.

Scandalous: It appears that the former director of the NGO Golden Children, Sothea Arun, has been investigated, but has still not been arrested. He is accused of a number of serious crimes including raping children and possessing child pornography.
Due to the apparent lack of progress made in this case, the NGO has posted this complaint (below) on their social media page on Facebook, presumably hoping to stir the competent authorities into action.

Cambodia News, (Phnom Penh): On June 1, 2022, the day of the International Children's Day, the NGO Sovann Komar / Golden Children called for the arrest of former Director of the Sovann Komar Orphanage, Sothea Arun, in connection with many crimes, including rape on children under his care. He was responsible for caring for 50 orphans and abandoned children.

Sovann Komar / Golden Children posted on Facebook that the shameless former director of Sovann Komar, Sothea Arun, was found with sexually explicit images and videos of animals and other pornographic images on his work computer at the Children's Center. The same Facebook page said that a team of forensic experts found the history of searches online in Sothea Arun's computer.

Here are some examples of pornography among the many pornographic websites that Sothea Arun visited:

Facebook added that Sothea Arun also kept pornographic images of human-animal sex on his computer.

Facebook Sovann Komar / Golden Children added that an investigating judge found that Sothea Arun had committed crimes such as child rape and pornography, abuse of power, fraud and embezzlement, yet he was still able to move freely. This person is a dangerous person, please do not have any contact with him. Please help the authorities to find this accused person by calling the police by calling 1288 if you have information about where this person is hiding.

The same Facebook page also published the order of the Phnom Penh Municipal Court, which charged and sought to arrest Mr. Sothea Arun from July and October 2021.However, regarding the above case, there is no explanation why Mr. Sothea Arun has not yet been charged and placed under arrest.

The NGO Sovann Komar say they are doing everything possible to get justice for the children and to see that ex-director Arun Sothea is held to account for his actions.

Last year, after an exhaustive investigation lead by Brad Gordon, we found substantial evidence that Mr. Sothea Arun had committed several serious criminal offenses including the abuse of children, extensive financial fraud, breach of trust, corruption, and coercion.

Once the major donor and founder of Sovann Komar realized the extent of these crimes, they took immediate action to protect the children and ensure their safety. The founder and donor to Sovann Komar has invested extensive resources to its response and to seek justice for the children who have suffered terribly under Mr. Sothea's leadership. The top priority of Sovann Komar has been to protect the children and families.

Sovann Komar has taken a range of appropriate legal steps to address the atrocious crimes committed by Mr. Sothea and to bring justice to the children who have been harmed. We have filed four criminal complaints (abuse, fraud and two rape complaints) in the Cambodian courts against Mr. Sothea Arun and his accomplices.

Child NGO wants former director accused of child sex abuse found

Sovann Komar, a local orphanage and school for abandoned children, has called on authorities to expedite the arrest of Sothea Arun, its former executive director, who is accused of allegedly being a “child rapist”, and who has been on the run for nearly a year despite two warrants for his arrest.

Founder and executive director of Sovann Komar Arun Sothea was sacked from the NGO in August 2019, along with Nou Savath, its former head of security, and about a dozen other staffers.

“They accused me of making mistakes, being corrupt and embezzling the organisation’s money,” Arun told Khmer Times at that time. “So, I think it’s strange that they’ve made such accusations because I was one of the organisation’s founders.”

Phnom Penh Municipal Court issued two arrest warrants for Arun, first on July 29, 2021, and the second on October 11, 2021, for “fraud and raping children”. The arrest warrants were issued after an investigating judge found evidence of torture, child sexual abuse, fraud and embezzlement at Sovann Komar, which Arun had managed for more than 15 years.

...Major General Kim Pheap, deputy director of the Ministry of Interior’s Anti-Trafficking and Juvenile Protection Department, told Khmer Times by telephone that he was not familiar with the case and that he was busy with other work, but that authorities were working on the case.
“If a judge issues an arrest warrant, we must act on it,” he said. “We will try to learn his whereabouts, and we will cooperate with relevant agencies.”

UPDATE
No news on the whereabouts of the ex-executive director of the NGO Sovann Komar, Arun Sothea, but two more recordings of and about him have been posted on the Sovann Komar facebook page this past month.
- In the first one, the orphanage doctor confirms that in 2017, he treated a child who had been beaten with a belt.
- The second one is a disturbing transcription of a conversation between Arun Sothea and his one of his foster daughters, where he asks the girl to record a (false) statement for the court saying that he is innocent of the allegations of rape and child abuse.

Context:

Sovann Komar added that the man had been charged with raping two girls, one of whom was only six years old. The victims testified in court that sexual assault and rape had been ongoing since they were children and continued until they were teenagers.
According to the second arrest warrant, Arun was charged with “Sexual Harassment and Rape” at Sovann Komar committed from 2010 to 2017.
