American facing jail for negative reviews of Thai resort

Thailand is Cambodia's neighbor to the West, and this forum is dedicated to Thai news, stories, reviews, blogs, videos, Thai people and anything else related to the country. A lot of expats have both lived and worked in Cambodia and Thailand, and this area is a place to discuss all aspects of life in Thailand and what's going on there. Most topics are about Bangkok and Pattaya because of their larger populations of expatriates and tourists in those cities, but this is for all things Thai.

Well done, TripAdvisor! They have a duty to protect travelers who leave reviews with them.

Tripadvisor have really run rings around the resort, and the Thai tourist authority...
Tripadvisor CEO Steve Kaufer said he doubted any tourism board would want their destination known as one that jails people who write hotel or restaurant reviews. “This extraordinary action is why we have taken steps to issue an alert.”
What they need to do is make sure this development is seen by every tourism related business in Thailand and that if the business owners want to kill their business then this is how they do it!

The owners of Sea View resort will also not be able to simply re-name the business.... Given the amount of hassle they caused, Tripadvisor will review any re-naming carefully to make sure it wasn't just "put in a family members name" or something along those lines.

Also, on a side note. The article says the reviewer left Thailand but it didn't say he returned home so he may have come to Cambodia.
Not sure how that will work out for you given your 5 minutes of fame has now put your name well and truly out there. Though, to be fair, I for one will have forgotten about you in less than a week.

Lots of western snowflakes. Try telling someone on Facebook the truth. Like how many genders there are, for starters. I think Thai/Eastern culture is way more tolerant of other opinions in many respects.

But yeah, defamation laws in SE Asia protect the rich.

Good thing that doesn't happen in the west, LOL

What a bunch of jerks. Hope this hotel goes out of business.

But now that the guy who complained is free, it would be interesting to hear a debate between the two over what really happened. I.e. a fact finding.

Apparently the guy wrote that the hotel conducts "modern day slavery" based on his observation of a manager talking to a staff. Seems a bit over the top as he presumably doesn't even speak Thai.

Regarding news about our hotel and the TripAdvisor notification on our review page, we would like to clarify the following information.

The hotel respects the consumer's right to express opinions and welcomes constructive feedback and authentic reviews. Our page on TripAdvisor shows both dissatisfied reviews and many positive reviews. The hotel has always taken guest’s feedback to assist us in improving ourselves. Guests’ dissatisfied reviews are always answered via the review website which is our standard response procedure.

This particular guest had created numerous false malicious reviews to purposely defame the hotel on several websites, causing damage to the hotel. He used fake accounts to create malicious reviews with content including slavery, xenophobia, and coronavirus.

Initially, we hoped to negotiate with the guest to stop the stream of malicious reviews. We had tried to contact the guest several times to request him to stop his actions. However, the guest refused to respond to or acknowledge the hotel’s correspondences and continued to post malicious reviews online.

As a last resort, the hotel was required to file a report and take legal action to protect our rights, our business, and our employees' welfare who had been abused by the guest.

This guest also has an ongoing felony case for unlawful use of a weapon for shooting within a premise of a bar, and a convenience store with a .40 pistol (among other counts). The guest is wanted under and fled from an arrest warrant from Kansas City, Jackson County, Missouri, USA (Document of warrant https://bit.ly/3ktziNr). When the police took him into custody according to the law and set bail. During custody, this guest could not bail himself out in time. He later posted bail and did not receive any imprisonment sentence.

The guest later confessed that he acted in bad faith and apologized to the hotel. The hotel has since withdrawn the complaint . Even now, a review from this guest on TripAdvisor still remains on our review page. The hotel did not enforce law to block his review or force him to review us positively. We simply wanted him to stop defaming us with information unrelated to his experiences at the hotel and end his slanderous campaign. The first review of this guest was removed by TripAdvisor as the hotel reported after it was published online for allegedly not following TripAdvisor guidelines.

We are disappointed that TripAdvisor has not remained impartial and decided to dishonor the agreement by downgrading our ranking along with displaying a notification on our review page even when the hotel is not in the wrong. Furthermore, both parties have already agreed to settle this matter. TripAdvisor did not provide all the facts regarding this case, making their notification very misleading. Even though we have tried to explain the situation to TripAdvisor and requested their advice several times, TripAdvisor has never provided us with a concrete solution on how they can assist businesses to stop consumers from using their platform to attack businesses out of evil intent.

The hotel would like to thanks Google (Google Reviews) for being impartial, assisting and protecting the hotel from false, slanderous reviews from this guest and multiple online malicious reviews that came after because of this incident.

Lastly, we believe that freedom of speech and expression should be based on facts. By utilizing freedom of speech, one should follow ethical and humanitarian principles and never use false information as a tool to violate others' rights and harm others.

1: Hotel management are morons and have no concept of PR.

2: Wes is an antagonistic, small brain, wankstain.

Most public disputes seem to be the same, both parties are repulsive in different ways. As with Facebook, we don't take defamation seriously enough in the West, but in Thailand, it's a tool of oppression. Since Farcebook chooses to impose censorship, they should be equally liable for any defamation they do publish.

You just know the people at the TAT are itching to jump in on the side of the hotel. In their self-centred little world they know the hotel did nothing wrong and have probably said so privately to them. If they do then maybe, it will become standard practice for tour companies and booking sites to have a country wide warning posted to all Thai businesses that negative reviews should only be posted once the guest has left the country.

If the above happens, and given the currently state of the travel industry as a whole, this would be devastating.
Well, devastating for them but amusing to everyone else who saw it coming.

1.On January 9, 2019, Electronic Sentencing Alternative filed a violation report, the facts supporting this report are as follows:
a.Defendant has absconded from Electronic Sentencing Alternative monitoring.
b.Defendant failed to report to scheduled meeting with Electronic Sentencing Alternative.
All attempts to contact Defendant have failed.

Next thing on the public record
He turns up as a teacher in Thailand.
Gets arrested for sniping from the safety of the internet
- "Hey, its that gutless punk drive-by shooter kinda hero guy again"

I just lost all sympathy.
