Who to trust: lawyer? Real Estate? to sell land in Cambodia

Hello,

Ma father bought land in cambodia throught his family that lives in Cambodia.

It may be time to sell the land but who to trust? Lawyer that speak english or Real estate that speak english that won't rip us off

When money is involved especially in a porr corrupt country, we can't trust no one

Any advice are welcome

What kind of deeds does he hold? Hard or soft titles? Whose name are these papers in?
If they are in a distanced relative's name it might not work out in your favor.
Also, although some land here in urban areas and close to national routes can fetch very high prices,
there are many areas where the land is not so good and it's too far away from anything and it isn't worth much at all.

I don’t know if it’s hard or soft title, the documents are in Cambodian

The papers name are relatives names not distances because my father still have contact with them

Who organized the sale of the land ? Your father must've trusted someone to draw up the papers when he bought the land ? And surely your father knows if it is a hard or soft title - hard titles cost more and are worth more. However, most property is soft title.
For a start, why not get the title documents translated by an official translator wherever you are, so you have a better picture. Then do some internet searches on hard and soft land titles in Cambodia which will explain what it all means.


Unfortunately, finding honest lawyers in Cambodia seems to be rather difficult and I cannot help you there.

Take the papers to the local Sangkat and get them verified.

Whilst their fees may be a little higher than others, they are about the only competent, trustworthy Real Estate Company in Cambodia. They can arrange everything, no need to hire a lawyer separately.

Be aware, that only the person (local) who's name is on the Property Title can legally authorise the sale of the property. If your father was legally married in Cambodia to a Cambodian Citizen at the time of purchase, and that person is the one whom the property was purchased under, then authorisation from both of them is required.....Unless the property is a Strata-Titled Condo, which foreigners can legally own 100%.
