sentenced to 103 years in Thai prison for money laundering

Thailand is Cambodia's neighbor to the West, and this forum is dedicated to Thai news, stories, reviews, blogs, videos, Thai people and anything else related to the country. A lot of expats have both lived and worked in Cambodia and Thailand, and this area is a place to discuss all aspects of life in Thailand and what's going on there. Most topics are about Bangkok and Pattaya because of their larger populations of expatriates and tourists in those cities, but this is for all things Thai.

BUT !......................

" the court knew Johan van Laarhoven and Tukta were innocent and that in reality they had no case against them – but that he ( the judge )was instructed by powers from above to execute and sentence the verdicts. "

Wow, that is one crazy story. Thank you Dutch Embassy.
Johan van Laarhoven and his wife Tukta are being held prisoner by the Thai court while being innocent.

The blame of this whole situation leans for a big part on the shoulders of the liaison officer at the Dutch Embassy in Bangkok and the Dutch Department of Justice, because of the false and misleading information they supplied to the Department of Justice in Thailand.

they talk about a new minister of justice called Ivo Opstelten who is very anti-cannabis.

also that letter addressed to the attorney General of Thailand by the law authorities in the Netherlands.

it will be a challenge to set aside this verdict which sounds very much like it was based on a mutual understanding between people at the highest levels and based on nothing more than a personal dislike of marijuana even though it was legal before in Holland.

If this is the case it absolutely sucks

Update on this crazy story about a Dutch couple who are in prison in Thailand because they were selling cannabis - legally - in the Netherlands. The Dutch authorities continue to ignore his pleas for assistance.

Johan van Laarhoven Jailed in Thailand for 103 Years asks Dutch King for Rescue

BANGKOK – Dutch cannabis pioneer Johan van Laarhoven, who faces a 103-year jail sentence in Thai prison, has written a letter to King Willem-Alexander of the Netherlands, pleading for help freeing him from “this Thai hell.”

“I didn’t do anything illegal,” Van Laarhoven, 53, wrote in his to the king. “I earned money in the Netherlands by selling cannabis. The Thai acknowledge that they have only convicted me for selling cannabis in the Netherlands. And they confirm that I have never done anything illegal in Thailand.”...

The Dutch government has so far refused to ask the Thai government to extradite Van Laarhoven, and conditions in the Bangkok Remand Prison are trying. Van Laarhoven reportedly shares his 50 square-meter cell with 49 other inmates, and his lawyers and family say his health is seriously deteriorating...

Dutchman's 20-year jail term upheld
21 Jun 2017
The Appeal Court has upheld the lower court's ruling sentencing a man from the Netherlands to 20 years in jail but it lowered the term for his Thai wife from 11 years to seven years and four months in a 2014 money laundering case.

Johannes Petrus Maria van Laarhoven, 57, and Mingkhwan van Laarhoven, 35, were given the prison sentences for colluding to launder at least 100 million baht between July 3, 2008 and June 2, 2014, said the Appeal Court's ruling read yesterday.

The lower court on Nov 10, 2015 sentenced the husband to 103 years on a total of 43 counts and the wife to 18 years on 13 counts, for colluding to launder money earned from the illegal trade of cannabis, said the ruling. The court, however, had the prison sentences commuted to the maximum of 20 years for the husband and 12 years for the wife, it said...

Thailand’s Supreme Court Upholds 20 Year Sentence of Dutchman
By CTN News on August 28, 2019
BANGKOK – Thailand’s Supreme Court has upheld the lower court ruling imposing a 20-year jail term on a Dutchman. The Dutchman and his Thai ex-wife, laundered Bt300 million baht acquired from marijuana sales in the Netherlands through Thailand.

Johannes Petrus Maria van Laarhoven, 59, was found guilty of 15 counts of wrongdoing and originally received a 103-year prison sentence. His wife, Mingkwan Kaen-in, 37, was found guilty of colluding in the money laundering and given an 11-year sentence.

In consideration of their testimonies, the court commuted Laarhoven’s sentence to 50 years and Mingkwan’s to seven years and four months.

The Dutchman’s jail term was then further reduced to 20 years, which is the maximum period of imprisonment for money laundering.

The pair had earlier denied the charges, but Laarhoven’s claim that he obtained the money legally failed to convince the judges.

Laarhoven and Mingkwan were arrested by Thai police with the help of Dutch authorities on July 23, 2014.

The officers impounded their land, eight copies of their title deeds, five luxury cars, and the rest of their valuables, worth a total of 100 million baht.

As a matter of fact, marijuana/ cannabis is illegal in the Netherlands, but the sale and possession for recreational use is tolerated and not prosecuted. However it is possible that when someone makes millions of dollars selling cannabis the Dutch authorities maybe say, this is taking the piss, and find a way to do something about it. The guy and his wife move their millions to Thailand, the Dutch authorities have a quiet word with the Thais, next thing justice is served. The only thing that is surprising is that he couldn't buy his way out of it given the almost total corruption in the Thai system. Must be some big pressure from somewhere, my guess is the Dutch are sending a message.
