Who is responsible for new road construction near train tracks?

Near our area we have a nice shiny new 2 lane road that runs a good 4-5km.
The folks who made it though left the dirt road for about 25-30 meters on both sides of the train tracks which is filled with pot holes the size of a Kia Visto.

Is Royal Railways or someone else responsible for street construction and maintenance within some certain distance of the tracks?
