Government dismisses VN immigrant claims

Senior government officials on Wednesday rejected claims in a report by Hanoi-based daily, Viet Nam News (VNS), that quotes a senior Vietnamese official as saying that 70-80 per cent of its nationals living in the Kingdom are recognised by the Cambodian government, allowing them citizenship.

Keo Vanthan, the deputy director-general of the General Department of Immigration at the Ministry of Interior rejected the report, saying his department is seizing all irregular documents held by immigrants of every nationality.

“We are withdrawing [illegal documents] even if they are immigrants who have lived here a long time. The General Department of Immigration requires them to file applications to gain legal [status]."

“Some of them [have received] recognition from the [Ministry of Interior] and have permanent residence cards. But some of them have not and claim they hold Cambodian documents, but these were irregular so we withdrew them,” he said.

Tens of thousands of foreigners living illegally

The Ministry of Interior has reported that more than 81,864 out of 182,673 foreign nationals surveyed in the Kingdom are holding invalid Cambodian documents, noting that the majority of them are from Vietnam.

“We have revoked 35,001 irregular Cambodia administration documents held by foreigners,” an Interior Ministry report said yesterday.

It added that last year, the ministry issued visas to 2,782,297 foreigners and collected $87,750 in fines from those who overstayed.

The report also said in order to reduce the number of illegal foreigners, the government has cracked down on those who have overstayed or who are involved in crimes.

It also said that last year 1,348 foreigners from 52 countries who were involved in crimes were arrested and deported.

Deprived of citizenship, the Vietnamese of Cambodia live on the edge of society

Situated in the center of Cambodia is the Tonlé Sap lake, translated as the “Great Lake.” Its length reaches 250 km, spanning several provinces and cities. Connected to the capital city Phnom Penh by its long river system, the Tonlé Sap lake and river have sustained the development of the country throughout its rich history.

Cambodia shares its eastern border and large parts of its history with Vietnam. Periods of wars and immigration between the two countries have led to a significant population of ethnic Vietnamese living in Cambodia today. The tense history between the two nations has influenced the perceptions of ordinary citizens to this day, with many Khmers continuing to view the Vietnamese with resentment and suspicion.

According to a 2014 report on the living conditions of Vietnamese in Cambodia, it is estimated that nine in ten ethnic Vietnamese in Cambodia are undocumented. The Cambodian government attributes that figure to illegal immigration. This attribution overlooks a significant population of Vietnamese in Cambodia today that can be traced to mass immigration that occurred over a century ago during French rule over Indochina when different laws governed the country.

After the French withdrew from Southeast Asia, targeted discrimination of Vietnamese by the Khmer Rouge attempted to purge the existing ethnic Vietnamese population from Cambodia by deportation and execution. Those not executed had their possessions confiscated, including birth certificates and any documentations that proved citizenship.

Discrimination persists to the present day through laws enacted to retroactively block paths to naturalization. The 1996 Law on Nationality supersedes a 1954 law and places additional requirements on non-citizen children born in Cambodia to become naturalized. The new law requires that both non-citizen parents of the child be born in Cambodia, when formerly only one parent was required to be, before the child can be granted citizenship. Furthermore, those who have had their citizenship paperwork confiscated under the Khmer Rouge are unable to have their applications processed, and applicants have no sympathetic authority to appeal to.

As stateless people, the ethnic Vietnamese on Tonlé Sap do not have the same protections and privileges as the citizens of Cambodia. They are not allowed to purchase land, their access to education is limited, and they are subject to arbitrary taxes and abuse by the local government.

Unlike many of the Vietnamese accused of living in Cambodia with illegal documents because their civil papers have been declared invalid by the Cambodian authorities, these people are recent arrivals from Vietnam who have entered Cambodia illegally.

Cambodia Breaking News (Kampong Cham): On July 10, 2019, 5 Vietnamese men were arrested for working and living illegally in Cambodia.
The operation was led by General lieutenant Em Kosal, Kampong Cham police chief, and coordinated by lieutenant Seth Sela, Deputy Director of the provincial Immigration Department. The police said the suspects had no passport, and had come to live in Cambodia illegally through the Prek Chak border in Kampot on May 31, 2019 .

The 5 Vietnamese men were sent to the Immigration Department to be deported.

It is necessary to issue monthly tourist visas to all semi-legal Vietnamese and let them live in Cambodia as expats :)

Report: Cambodia Seizes 40,000 Copies of Unauthorized Documents from Foreign Immigrants within 30 Months

Phnom Penh (FN), July 17 – The 30-month process of seizing unauthorized administrative documents from foreign immigrants in Cambodia was concluded on 30 June 2019.

According to the report of the General Department of Immigration released today, 17 July, Cambodia has a total of 182,673 immigrants of 11 nationalities.

Within the period of 30 months, police found that at least 73,400 holds illegal documents. The report added that approximately 40,000 copies of unauthorized administrative documents were seized.

Kirth Chantharith, director-general of the immigration, proposed for amendments to the law on immigration and amendments to relevant legal instruments for better management of immigrants.
