If he was on drugs, can he claim withdrawal symptoms?

Fraud is probably a mistranslation. News report here says that the suspect committed an act of violence on an ATM, not that he was attempting to defraud the bank.
A 40 year-old Italian man was arrested on Tuesday in connection with breaking ABA Bank’s ATM Machine over his anger that he could not withdraw his money from the ATM.

Christian Patella has reached out to CEO to tell his side of the story:

"Dear CEO admin,

i am the person involved in the news published by your site on May 29 2018
about the atm "attack".
I decide to write this mail to you because i think that what was reported
on the news do not match at all what really happened that night.
I was arrested and threatened with jail time with the only intent to extort
money from me.
Probably being an expat in this country you are aware how things works with
police, lawyers etc.
Therefore i kindly ask you to remove the article,i suffer enough economical
and emotional damage from that and no need further online shaming.
Please feel free to mail me if you need detailed information about this
story, i ll be happy to answer any questions.

Best regards,
Christian

A bit light on details. The poor chap was so spaced out he couldn't remember a thing he had been doing.

Spaghetti Bill.
If this is a reference to Taco Bill, he is now Botanico's goodwill ambassador for peace, love and joy.

What gender are ATMs?

Could this count as attempted rape?

Or will he claim he was in dire kneed?
