Government Passes Law to Regulate Organ Donation

BY KANG SOTHEAR | JULY 1, 2016

Ruling party lawmakers unanimously passed a law regulating how human cells, tissue and organs can be donated or used in the country during a session on Thursday at the National Assembly, with the CNRP continuing its boycott of parliament in protest of a legal assault against the opposition.

The impetus for the Law on the Regulation of Donation and Adaption of Human Cells, Tissues and Organs was the increasing vulnerability of low- and middle-income countries to organ trafficking, as well as increasing rates of diabetes requiring kidney transplants, according to a statement signed by Prime Minister HE.

Approved by the Council of Ministers on May 27, the law sets strict regulations and possible punishments concerning various uses of human cells, tissue and organs—which previously fell under Cambodia’s anti-human trafficking laws. It includes articles controlling the trade in organs, adaptation of cells and tissue for commercial use and advertisement of the sale of organs.

The new law is intended to protect poor people LS, but I don't think it will make much difference in reality. Organ-trafficking will continue disguised as donations.
The law, which also covers human cells and tissues, stipulates that any donation of human parts must be undertaken on a humanitarian basis – commercial motives and advertising such services are forbidden and carry jail sentences of up to 20 years...

The law states that anyone who removes body parts without the consent of the victim faces a jail term of between seven and 15 years, while implanting cells, tissues or organs for a commercial purpose carries a 10- to 20-year sentence.

Advertising centred on the buying or selling human organs carries a sentence of between five and 10 years.

The law stipulates donors must be aged 19 or over, and cannot donate if they have a cognitive impairment.

The Ministry of Health is required to install a committee to oversee and grant permission to medical professionals who transplant organs, cells or tissues.
