Exhibit A: a girl shows up at my door totally wasted and almost passes out on me. I'm fully sober and in possession of all my faculties. I see that she's obviously severely drunk, but I then start using her as a human fleshlight.
Exhibit B: I'm completely drunk and an equally drunk girl stumbles towards me and starts groping me. After some fondling we end up having sex. How am I in a position to know whether or not it was appropriate to have sex with her at that particular time?
A=Obvious rape. You're taking advantage of someone who obviously couldn't make very good decisions at the time.
B=Both parties are drunk as hell. Both share a certain level of responsibility for the sexual encounter, which wasn't forced by anyone.

I'm not saying that being drunk is an excuse to get softer sentences. I'm saying that in this particular case, given that the female was very drunk, if the male was also drunk then it's hard to blame him for having sex with her, especially if it's true that she started getting flirtatious and "friendly" with him. And once he moved forward she didn't resist in any way. But yeah, I'm no lawyer, but I can imagine a jury giving a leaner sentence to someone in that position. The reporting is weird, but it's not impossible that the girl actually told the police that she thought he was her boyfriend. Then how the hell can you blame the old dude for getting it on with her, given that she was (allegedly) actively participating? Anyways, a lot needs to be cleared up as so far the info is a bit sketchy.

Maybe not rape, but certainly a lot of coercion was going on. She's cornered in a room with a bunch of dudes. If you keep saying please over and over to someone who keeps saying no, and you keep it up until they eventually say yes... Then I think you'd have a case in saying that the person made the decision under duress. They still should have just stood their ground, but I think morally the guys should have known better. But then again, I don't know the case and maybe they asked her like 3 times before she accepted and started smoking their poles and begged them to DP her.

Again, I'm no lawyer and nothing I say is meant to have any weight legally. Just philosophically-speaking.
