I have to agree that at this moment, her case is flimsy at best. Maybe it's the reporting, but it sounds more like a case of the woman having consensual sex and then waking up (and sobering up) to find someone less than appealing next to her rather than a classic rape case. If she had found some backpacker guy of the same age next to her that morning, I wonder of she would have called them cops or just felt ashamed and made up some story to her boyfriend. I mean of course there are grounds for rape as she was clearly impaired, but if she never resisted the guy at the time (and apparently even actively participated?!), he must have just thought it was his lucky day and he was finally being recognized as the brown sugar-daddy stud he always thought he was.

Was he also drunk? This also affects the case I'd say. But with this limited info so far, it sounds more like a case of the good old waking up and realizing: "Aaaah shit, I've sunk to a new low!!!!". Like that Louis CK skit when he realizes he's someone else's bottom of the barrel.... Either way, I'm willing to bet from now on, she'll stop drinking herself blind. It's quite unfortunate, but sadly for her I don't see how the courts can give him a severe penalty given the circumstances. Of course it all depends... Was she literally blind drunk and passed out on his doorstep, and he then "helped himself"? That's definitely rape. But the reporting paints a vastly different picture, legally-speaking. Was the man completely sober? Was he quite drunk as well? Many questions remain to be answered. At the end of the day it's most likely still rape, but depending on the perpetrator's own level of impairment, I don't see how the courts can go all out on him.

I do wonder about the reporting. The reporting in Cambodian newspapers is not very good to begin with and it can be particularly insensitive and cavalier in the reporting of this sort of possible crime. Though, if the story as it was reported here is accurate and the relevant details complete, on the surface it does not sound like rape. This of course does not mean that he won't be convicted of rape. There is often very little relationship between evidence/legal arguments and the verdict in Cambodian courts. If, for example, they want to show that they are protecting tourists in Siem Reap he may be convicted for that reason alone. Be interesting to see what if any more details come out.

How? In your perception maybe but surely not legally. I can't imagine a court anywhere, including Cambodia, to accept "I was drunk" as any special circumstance to even consider in deliberation and sentencing, and especially in a rape case.

There was a "rape" at my university when I was going there. A girl was a booty call of a guy on the football team. He called her up late one night and she went over to his dorm. There were 4 or 5 other players there. They asked her for sex. She said no. They said please please please. She finally said ok and did them all. Later she claimed rape. At no time did they hold her or bar her from leaving the room. They just said please until she acquiesced. That's not rape. That's slutty behavior.
