I agree with that part. If punishment is the goal, the DP is less effective than other means.

I am opposed to the DP for the follow reason, which I have mentioned elsewhere.

-The calculated, cold-blooded, premeditated killing of a defenseless, restrained human being who poses no immediate or realistic long-term threat is wrong. Period. For me that is enough in itself.

-If punishment is the goal, death is way too easy. In fact the DP isn't even really much of a punishment because the punishee has little experience of it. Once dead, it's over for him. No pain, no loss, no fear, nothing. It saves him from prison and, in this sense, it is to his benefit. Unless Hell actually exists, the offender has no significant experience of the punishment besides the brief time before, and even that discomfort is relieved by the DP. The bulk of the punishment is really being inflicted on the family and friends of the criminal who have to live with his death.

-It gives too much power over the individual to the state. The state should not have the power of life and death. They can't be trusted with it. Give them an inch and they'll take a yard every time. And it is an especially bad idea in a place like Cambodia where the judicial system is totally corrupt, and regularly and blatantly manipulated for political reasons.

-Courts are fallible. It could (and has) happened to innocent men, and its impossible to amend. My home state of Michigan was the first English speaking state in the world to outlaw the death penalty for just this reason.

This morning judge ordered the imprisonment of the perpetrator

Battambang: According to Koh Santepheap Daily News, Eventually, after many hours had been spent for questioning the perpetrator, the judge of municipal court of Battambang decided to jail a 23 years old Cambodia man named Chan Kosal and he was convicted of murdering a 18 years old Cambodian.
