Cambodian court upholds jail term for land rights activist

PHNOM PENH -- A Cambodian court on Tuesday upheld a 2½-year prison term against a prominent land rights activist accused of inciting violence at a protest she helped lead outside of Prime Minister HE's residence, as dozens of her supporters outside conducted a “cursing ceremony” against national leaders and judges.

Tep Vanny was convicted in late February of aggravated intentional violence from the March 2013 protest, in which several government security personnel were hurt. The Appeal Court on Tuesday concluded that the trial followed legal procedures.

At her February trial, Tep Vanny said she was the victim in the case, and accused the court and the police of unfair treatment. She said the protesters, who were all women, were not violent, and that it was the security forces who attacked them.

Outside the court complex, about 30 of Tep Vanny's supporters organized a Brahman ceremony to curse the judges and national leaders. Brahmanism is related to Hinduism and Buddhism.
Tearfully holding incense sticks and candles, the women urged the Lord Hindu to punish national leaders, judges and their families.

- The Court of Appeal yesterday upheld a lower court verdict against land activist Tep Vanny who was convicted over violence involving security guards near Prime Minister HE’s house.

Ms Vanny has spent nearly a year in jail after her conviction for intentional violence with aggravating circumstances for a two-and-half year term imposed by Phnom Penh Municipal Court.

After the verdict, 50 residents of the Boeng Kak community lit incense to curse developers of the Boeng Kak area and court officials for what they called an unfair decision.

“Because of the power of dollars you have made thousands of families shed tears,” resident Song Sreyleap said, holding up three lit sticks of incense.

Rights groups condemn decision to keep land activist Tep Vanny in prison

In a decision roundly criticised by rights observers, the Appeal Court yesterday upheld a two-and-a-half-year sentence for Boeung Kak activist Tep Vanny for her alleged involvement in a 2013 protest outside Prime Minister HE’s residence in Phnom Penh that turned violent.

Presiding Judge Pol Sam Oeun said the court found no fault with the Phnom Penh Municipal Court’s decision to sentence the prominent activist to 30 months in prison.

“The council sees that there was violence that happened and complied with the charge of ‘violence with aggravating circumstances’, and that decision of the municipal court was correct,” he said, referring to the three-judge panel.

Vanny was convicted last September for allegedly ordering an attack on around 200 Daun Penh security guards, police and Military Police personnel, as she and fellow activists attempted to deliver a petition to Prime Minister HE’s home near the Independence Monument.

The lake resident – one of the most prominent faces of the acrimonious and long-running land dispute between Boeung Kak residents, developers and City Hall – was sentenced to 30 months, fined 5 million riel ($1,240), and ordered to pay 4 million and 5 million riel in compensation, respectively, to plaintiffs Hao Hoeurn and Ouk Ratana, both of whom are Daun Penh security guards...

Note that Tep Vanny - woman activist - was convicted of violence against two armed members of Daun Penh security forces, who are known for previous allegations of violence against unarmed women and protesters.
It is alleged that Tep Vanny's conviction is based on political reasons, and the UN Special Rapporteur for Human Rights, Rhona Smith, who is visiting Cambodia from 8 to 18 August 2017, is being asked by Cambodian activists to take up her defense.

Community demands justice for Tep Vanny

Residents of the Boeung Kak community yesterday requested UN Special Rapporteur for Human Rights in Cambodia Rhona Smith and ASEAN embassies to campaign for the release of land activist Tep Vanny, who has now been imprisoned for one year.

Ms Sreyleap added that she hopes Ms Smith and the embassies of ASEAN countries will pressure the Cambodian government to respect human rights and release Ms Vanny.

Boeung Kak community representative and prominent land activist Ms Vanny was arrested in August 2016 while she and the community conducted a “Black Monday campaign” against mass evictions in her neighbourhood.
She was charged with using violence against Daun Penh security guards, near Prime Minister HE’s house in March 2013, and sentenced to two and a half years imprisonment.

Boeung Kak Lake activists' verdict today
- On 24 November 2017, the Supreme Court considered the conviction of four Boeung Kak Lake activists – Tep Vanny, Kong Chantha, Bov Chhorvy and Heng Mom – on charges of "insult [of a public official]" and "obstruction of a public official with aggravating circumstances".

If the verdict is upheld, they face six-month prison sentences – under Articles 502 and 504 of the Criminal Code – related to a 2011 land rights protests outside Phnom Penh city hall. Tep Vanny has been in detention since 15 August 2016 and is appealing another protest-related conviction.


The verdict is expected to be announced today, 8 December 2017.

Sounds like a brave woman.

Breaking: Sentences for the four women Boeung Kak Lake activists have been upheld, it was announced this morning at the Phnom Penh Supreme Court.

The four Boeung Kak women, Tep Vanny, Bo Chhorvy, Kong Chantha and Heng Mom are currently serving a six month jail sentence, charged with "insulting and opposing public officials with aggravating circumstances committed in front of Phnom Penh Capital Hall in Srah Chak commune Daun Penh, November 28, 2011 Article 502 and Article 504 of the Criminal Code" [aka peaceful protest.]

- Responding to the Cambodian Supreme Court’s decision which upheld the guilty verdict against Tep Vanny and fellow activists Bo Chhorvy and Kong Chantha, on charges relating to a peaceful protest they attended in 2011, James Gomez, Amnesty International’s Director of Southeast Asia and the Pacific, said:

“By upholding these unfounded convictions that stem from dormant charges, Cambodia’s Supreme Court has exposed, once again, the country’s compromised criminal injustice system.

Try telling that to the powers that be. If they had fined Tep Vanny and released her then she wouldn't have the profile she has now.
