Working group finishes disbursing Kep building collapse donations

The government working group in charge of collecting donations to support families of victims of the deadly building collapse in Kep province has wrapped up its task on Tuesday.

The group collected $2.2 million and has distributed the money to survivors and the families of those who died in the January 3 incident.

Speaking to reporters during a press conference to end rescue operations at the scene early this month, Prime Minister HE announced that the families of those who died in the collapse would each get $50,000 raised by the government and donors.

He noted that those who survived would get $10,000 each while seven victims who were trapped under the rubble for several hours would receive $20,000 each. He also said he hopes the payout will help ease the suffering and difficulties of victims who were injured and the families of the deceased.

Seng Tieng, Mr HE’s personal assistant who was in charge of the donation collection, confirmed yesterday that all the dead victims’ families and the survivors received the appropriation.

A total of 36 people, including children, were killed and 23 were injured after the collapse of the seven-storey building in Kep city on January 3.

Two months after the disaster of the building collapse in Kep, victims and their families are still waiting for a trial and compensation. Slow justice or no justice ?

No justice yet for Kep and Sihanoukville collapse victims
Survivors and families of dead victims of building collapses in Kep and Preah Sihanouk provinces are calling for justice over the deadly incidents amid little progress from the courts.

On January 4, a seven-storey building under construction collapsed in Kep province’s Kep city, killing 36 people, including children, and injuring 23 others.

The building owner Ek Sarun and his wife Chhiv Sothy were charged by Kampot Provincial Court with manslaughter under Articles 207 and 236 of the Criminal Code. However, they were released after posting an $87,000 bail.

Ouk Oeun, 48, a survivor who lost four family members, including his wife, in the Kep building collapse said yesterday his family has still not received justice.

Mr Oeun, who regularly goes to Vietnam to treat a pinched nerve he suffered during the collapse, said his family has not received any compensation even though he had filed a claim against the building owners through his lawyers.

“Until now, justice remains far away from us,” he said. “Since after the building collapse, I have received no information about the progress of the case and the court has not summoned me or my family members to provide testimony.”

Mr Oeun said his family is demanding $50,000 for each death and injury caused by the collapse. He urged the court to speed up the case and provide justice to all families of victims.

Tep Thon, a secretary of state at the Land Management Ministry and head of the working group to probe the collapse, previously told Khmer Times poor quality cement was used to coat iron bars which supported the seven-storey building.

However, when asked who would be held responsible for the incident, he referred the question to the Kampot provincial court which is handling the case.

Contacted yesterday, Kampot provincial court spokesman Mann Boret said the investigating judge Long Kesphirum, also court director, has not finished his probe yet.

“The Kampot provincial court has questioned many victims and the case is ongoing,” he said. “I cannot tell you when this case will conclude.”

Mr Boret said he also could not say when Sarun and Sothy would be tried over the charge.

The couple could not be reached for comment but their lawyer Kong Sam Onn has claimed they should not have been charged. He pinned the blame for the collapse on a contractor who died during the incident.

The building collapsed in June last year killing 28 people and injuring 26 others.

Law on Construction expected to prevent structural failures

Kep provincial governor Ken Satha yesterday blamed the lack of a construction law for the deadly building collapse in Kep city earlier this year, which took the lives of 36 people, including children, and injured 23 others. His statement came amid continued demands for justice and compensation from survivors and families of the victims.

Speaking during a press conference organised by the Royal Government Spokesperson Unit at the Office of the Council of Ministers yesterday, Mr Satha said the government’s working group has concluded its investigation over the accident but refused to provide details of their findings.

“We regret what happened in the past,” said Mr Satha. “Now, we have enforced the Law on Construction. This law is very strict and places the responsibility on building owners, requiring them to have their buildings undergo routine inspections.”

Building owners Ek Sarun and his wife Chhiv Sothy were arrested after the January 3 collapse and charged by Kampot Provincial Court with “manslaughter and causing involuntary bodily harm” under Articles 207 and 236 of the Criminal Code.

However, they were released after posting an $87,000 bail.

Construction worker Ouk Oeun, 48, one of the survivors who lost four family members in the tragic collapse, said yesterday he and his colleagues were summoned to testify at Kampot Provincial Court last month.

“The court asked us how much compensation we want. Our stance is the same: we demand $50,000 for each victim. We want justice to prevail. We want to see the building owners be convicted and be paid what we are due,” he said.

Sou Chhlonh, first vice-president of the Building and Wood Workers Trade Union Federation of Cambodia, said recently: “The building owners must be held accountable for the collapse because they were the ones who ran the paperwork for the building’s construction. They cannot just put all the blame on the contractor to clear themselves from blame.”

Families of Construction Workers Killed in Kep Last Year Call for Justice

More than one year on since a tragic building collapse that saw 36 Cambodians perish and another 24 injured, families say that the government has failed to prosecute those responsible.

PHNOM PENH--Cambodian Construction and Forestry Worker Union Federation (BWTUC) on Jan. 3 launched a campaign seeking justice for the 36 construction workers who died in a building collapse in Kep Province last year.

A 7-storey construction site collapsed on Jan. 3, 2020, killing 36 Cambodians—including six children—and injuring a further 24. More than a year later, the families of those who perished are still seeking justice and compensation for the loss of their loved ones.

But Prime Minister HE’s volunteer lawyers in Kep Province said that the case has already been resolved and that they are currently awaiting the verdict which is to be announced on Jan.13, 2021.

BWTUC has launched a 10-day social media campaign—from Jan. 3, marking the one year anniversary of the fatal building collapse.

“Stop killing construction workers! Stop it now! Those who cause workers to die must be punished. Justice must be had for victims,” is the slogan of BWTUC that is being shared across social media.

Suo Chhlonh, Vice President of the Cambodian Construction and Forest Worker Union Federation said that families of the victims have not yet received legal justice and court proceedings have still not progressed.

He said that BWTUC's members took the anniversary of the tragedy to urge the court to accelerate its procedures and give justice to families of the victims.

“We want to see justice for them as a year there was no result yet, not seen it yet. On the day of the incident, [we] saw the construction owners were arrested but after that, they were released,” he said.

Following the collapse of what was to be a guesthouse for tourists, the husband and wife owners of the building were arrested, but were released on bail and fined $90,000. As the death toll rose to 36, the owners were barred from leaving Cambodia.

Chhouk Su, mother of one of the victims, commemorated her son's death on Jan. 3, 2021. Losing her 15-year-old son, she received $ 50,000 from the government and other supporters, but said she wanted to see justice served to those responsible for her son’s death.
She said that it was difficult to follow the legal proceedings and that she did not understand the court case and its procedures, so she is wary of seeing those responsible for the death of her son—and 35 others—punished.
“I did not know how to analyze in the right way because I did not know and understand about [law],” she said.

Centre for Alliance of Labour and Human Rights executive director Moeun Tola said that justice for the victims of the building collapses, in Kep Province and Sihanoukville, have very little hope as the court process is not moving forward as it ought to.

He added that charitable assistance to the families of victims does not constitute a legal settlement.

HE's volunteer lawyer Muong Thunleaphy, who oversees proceedings in Kep Province, stated that the case has been resolved and that the verdict would be announced next week. She declined to say more.

Kep currently does not have a court of its own.

Kampot court orders reinvestigation into deadly Kep building collapse
The Kampot provincial court today ordered a reinvestigation into the deadly seven-storey building collapse in Kep province’s Kep city last year, which claimed 36 lives.

On January 4 last year, an under-construction building collapsed in Kep province, killing 36, including children, and injuring 23 others.

In the verdict announcement attended by some families of the victims and their lawyers, Presiding judge Men Vannak ordered a probe into the case again.

The owners of the building were absent.

Ky Tech, head of Prime Minister HE’s Volunteer Lawyer Group, said today that a group of his lawyers also attended the verdict announcement.

“With regard to the verdict, the court decided to ‘take action’ to further interview witnesses and seven experts,” he said. “[The court] will conduct a retrial of the case at a later date.”

Back to square one: Court orders reinvestigation into Kep building collapse

On the day when it was due to deliver a verdict on two accused over last year’s deadly building collapse in Kep province, the Kampot provincial court yesterday ordered a reinvestigation into the incident.

The decision shocked families of 36 victims, including children, who were killed and 23 workers who survived the collapse of a seven-story hotel under construction in Kep city on January 4 last year.

The building owners Ek Sarun and his wife Chhiv Sothy were charged with “manslaughter and causing involuntary bodily harm” under Articles 207 and 236 of the Criminal Code after they were arrested in Preah Sihanouk province days after the building collapse.

However, they were released on bail after they promised to follow the court conditions for bail and deposited about $87,000 with the court.

According to the law, manslaughter is defined as an act causing the death of another person through negligence, recklessness or carelessness.
The charges carry a jail term of between one and three years and a fine up to about $1,500.

Additionally, causing involuntary bodily harm is defined as causing an injury to another person through negligence, recklessness or carelessness. The charges carry a jail term of between six months and two years and a fine of up to $1,000.

Their representative has pinned the blame for the collapse on a contractor who died during the incident but said they are willing to provide compensation to the families of those who perished or were injured.

During the court session before a verdict was to be delivered, attended by some families of victims and their lawyers, Presiding Judge Men Vannak ordered authorities to reopen the case.

Ky Tech, head of Prime Minister HE’s Volunteer Lawyer Group which is helping the victims’ families and survivors to find justice, said yesterday that his group also attended the hearing.

“With regard to the verdict, the court decided to ‘take action’ to further interview witnesses and seven experts,” he said. “[The court] will retry the case at a later date.”

Since last week Building and Wood Workers Trade Union Federation of Cambodia (BWTUC) members across the country posted the picture of them holding posters and pictures of the collapsed building, calling for “justice” for the families of victims and survivors.

“If you killed a worker, you should go to jail,” one of many signs posted on Facebook said.

“Kep province building collapse, 36 tragic deaths, the killers walk free” another one read.
