Kem Sok Prosecuted

Phnom Penh (FN), June 9 - Kem Som was tried in Supreme Court Friday morning.
He was arrested on February under allegations of incitement and public defamation, which are punishable under Articles 305, 494, and 495 of the Criminal Code.

The premier is demanding $500,000 from Kem Sok for accusing the Cambodian People’s Party (CPP) of murdering Kem Ley, according to the premier’s lawyer Ky Tech.

Kem Sok is also facing an additional suit for defamation. That lawsuit is seeking an additional $2,500, according to Ky Tech.

The second lawsuit was filed after a statement Kem Sok made during a live radio station on Feb. 13 in which he said, "This refers to the system … a system under this government to murder people in which the murderer is never to be found including Kem Ley and other activists ….”

PHNOM PENH (Reuters) - Cambodia jailed a political analyst for 1-1/2 years on Thursday, for accusing Prime Minister HE's ruling party of orchestrating the 2016 murder of a prominent government critic.

The sentence is the latest blow to Cambodia's opposition, which has accused the government of intimidating its activists and using the judiciary to silence critics ahead of a general election next year.

Kim Sok, 36, was found guilty of defamation and incitement over a Radio Free Asia interview he gave in February, in which he accused HE's Cambodian People's Party (CPP) of being behind the July 2016 murder of government critic Kem Ley.

"Kim Sok's accusations affected the dignity and cleanliness of the CPP," the judge, Ky Rithy, said in reading the verdict..

Serey Ratha, who returned from self-imposed exile to start his party after a July 2015 pardon for a terrorism conviction, was detained over a social media post he made on Saturday while driving back to Phnom Penh yesterday, said National Police Chief Neth Savoeun.

Savoeun described Serey Ratha’s offence as “dividing the army to not obey commands and impacting upon affairs of national defence”, and said that it related directly to a post in which he criticised Prime Minister HE’s deployment of troops to the border.

Serey Ratha wrote in the post that any outbreak of armed fighting with Laos over its alleged incursions into Cambodia following Friday’s deployment to Laos would only lead to the foot soldiers getting hurt while the top echelons of the army and HE stay safe.

“The marshal gives the orders to the army to prepare to fight by putting an ultimatum for the enemy but then heads to the enemy’s fortress to negotiate,” Serey Ratha wrote, explaining that any fighting would be the same as past armed disputes with Thai forces.
“When war takes place with Laos, the result will not be different from the war with Thailand,” he wrote. “The Cambodian children in the army will die horribly on the battlefield, but their commanders will be promoted, collect money and have fun with girls.”

Serey Ratha’s deputy in the KPP, Soung Sophorn, said by telephone that he believed Serey Ratha’s remarks fell within his rights to freedom of speech, and said that the country’s military leaders should not consider themselves above any criticism...

The Cambodian PM comments about comments on the Laos border situation.

- Prime Minister HE has warned that he will take legal action against any commentator who suggests that the government exploits foreign incursions to drum up votes for the ruling CPP.
His remarks follow comments by political analyst Lao Mong Hay who suggested that the outcome of the Stung Treng border dispute with Laos had been dragged out.
Mr Mong Hay said it appeared that the government was delaying solving the problem until the 2018 election drew nearer to use a border victory to bolster support for the ruling CPP.

Mr HE responded as he presided over a graduation ceremony of the Royal University of Phnom Penh at Koh Pich yesterday.
“Anyone who makes comments on this has to be responsible to the law,” Mr HE said. “Laos invaded Cambodia. You cannot say it is a way for the CPP to find votes. We cannot accept this.”
“If you are in Cambodia we will arrest you because it is a real offence, and is related to national security,” he added. “Not that I’m a dictator, but democracy and rule of law are. Democracy without the rule of law is an anarchic process.”

He added that everyone should be cautious about commenting in ways that affect the dignity of the armed forces.
“I do not prohibit anyone from expressing opinions. You can express whatever comment you want, but do not interfere with their rights,” he said...

Woman Arrested for HE Insult Released

A woman who was arrested after calling Prime Minister HE a “traitor” online was released on Tuesday after being questioned at the Banteay Meanchey Provincial Court, according to police.

Mao Linda, 31, was arrested at her home in Poipet City on Saturday, the day after she criticized Mr. HE in a Facebook comment on a post by media outlet Fresh News about a speech given by the premier discussing the U.S. bombing campaign in Cambodia in the 1970s.
“Cambodia cannot accept HE’s family selling the land of the former king,” she wrote.

Mr. Luos said Ms. Linda had a long history of drug abuse—though a police-administered drug test this week came back negative—and suffers from “serious mental illness,” for which she had been previously treated by doctors.

According to a report on Wednesday on Fresh News, Ms. Linda was released temporarily after she agreed to write a formal apology letter.
It was unclear if she had been charged. A court spokesman refused to speak to reporters...

He and They can say what they like with no justification of content. You and Me cannot have opinions that even smell like a differing opinion on anything. A dictatorship is absolute power with the people having no say whatsoever. Cambodia is a freely elected democracy.

Another political party that I didn't know about. According to the Interior Ministry, there are currently 45 political parties in Cambodia.

Party president fined over missing reports

Phnom Penh Municipal Court yesterday convicted and fined the president of Khmer Economic Development Party for not sending required reports to the Interior Ministry.

Presiding Judge Than Leng said KEDP president Huon Reach Chamroeun failed to provide the ministry with activity reports on his party in 2015, contrary to rules under the political parties law.

“The court has sentenced him with a fine of four million riel [about $980] to be put in the state’s budget,” said Judge Leng.
