First of all I wish that people on both forums stop calling these land as royal, crown or whatever king related.
This is state public land, period. Cambodia ain't Thailand !

Secondly the beach lots would most certainly have been leased to the original tenants by the local authorities for a set price without any following rent due (I also heard figures of about 600 or 800$ as cited earlier)
These leases are state concessions and without being very specific about it, are transferable and do also allow subletting.
I have myself bought years ago such a lease in Ream and have had tenants rent if from me since. I actually bought 2 adjoining leases and the local authorities were very happy to take the sellers tea money and edit the original documents in my name (only since I am Cambodian).
My concession of this state public land isn't limited in time but it was also made clear that it could be revoked alongside my neighboors ones depending on the area future development.

Lol. They were bulldozing bungalows on the beach, to the outrage of their owners, when I first moved to Cambodia... it appears no-one learns any lessons of the past. Sihanoukville has always been a lousy place to invest in and this just confirms that. Though to be fair most of the businesses down there aren't even worth a month's takings so it's not like this is a huge loss either.

TBH, Otres isn't Sihanoukville or the locals wouldn't consider it Sihanoukville anyway besides Otres village is doing quite well.

Can Any Otres Barangs verify this ?

State public land...cannot build within 50m of the ocean....none of these business owners have any right to complain as they were not compliant with the land laws in the first place. "But i signed a lease" Boo-f***in-hoo...pays to carry out a little due-dilligence before spending your life savings on a beach shack!

As to the question re soft titles...they are legally binding, just not registered at the cadastral level yet, however there is a nationwide land registering process currently underway.

O'Tres beach is included - see the OP. I'm not from Otres but I did notice that some businesses on the beach have opened places in Otres village. Don't know if they had prior warning, or they were just thinking ahead (and with their heads, unlike some.)

I had a friend who wanted to buy beach property on one of the islands so he went to the sangkat who told him he would sell him some land but if he was later offered more money or if a developer wanted the land he would take it back and he would sell it again

It's only hearsay,but I heard that what goes for the mainland also goes for the islands concerning constructions on the beachfront. Also heard that some places on Koh Wrong have been bought for crazy money. At least your friend had the sense to check things out before buying.

Respectfully understood about referring to beaches as "crown land" or alike BDS

Admittedly, that was me, I actually read something on other news feed or article that referred to the "anything within 50m of the waterline" in that context... I understand better now....

Funny how this works as well - today's PPP:

"Local Otres vendor Ngim Keatha said yesterday that her family had been working out of a small business on Otres since 2000, when the local authorities gave them permission to set up there in exchange for clearing some of the forest area."

So no talk of any lease..... at least in that instance..... but yes, I got the picture!
