Eight charged over grenade, 2015 shooting

The Phnom Penh Municipal Court has charged eight individuals, including three Vietnamese nationals, for their alleged parts in the September 6 grenade attack on Phnom Penh’s Street 163 and a separate, but related, shooting from 2015.

Sok Kimly, a Cambodian national initially identified as Vietnamese, was charged on Saturday for allegedly masterminding the attempted murder of Ea Lyhour on two occasions – an attempted shooting in September 2015, and the Boeung Keng Kang III commune grenade attack this month.

Despite there being no deaths in the grenade attack, Kimly, Nou Samban, Sak Mab, Bun Pheakdey and his wife, Bou Sopheap, were charged on Saturday with premeditated murder, with officials declining to discuss reasons for the charge...

Yep, this is one of those OIC stories, where all could be true, partly true, or totally made up. For those who have not been following, AFAIK this is the what is known/said about the grenade attack for the moment (more or less): The "ringleader" or "mastermind" behind the attack is the woman shown in the photo, who may or may not be Vietnamese. She is married to a (probably wealthy) Chinese-Singaporean, but has taken a lover in Cambodia ( ethnic origins unknown). In an attempt to keep her lover faithful, this woman has lavished many gifts on him - things like big house, flash car etc - but the bastard laughed at her, took her gifts and played around elsewhere.
Woman is seriously pissed off and hires some people to shoot her lover. For some reason that doesn't work out, so she then hires the motodop-grenade gang, who also mess up bigtime - see the video.

The alleged ringleader behind a Phnom Penh grenade attack that injured at least three people during a September attempt to kill her boyfriend was in court on Monday accused of ordering his murder in an earlier attack.

Sok Kimly, 41, has been charged with premeditated murder along with four others for organizing the grenade attack on Street 163 in Chamkar Mon district. Vietnamese nationals Chang Thi Ve, 46, Le Dang Dong, 47, and Ni Soi Binh, 36, face charges of attempted murder.

Police accused the group of attempting to kill Ea Lyhour, who owns a motorbike accessory store just meters from the blast site, but was not injured.

All four were on trial on Monday at the Phnom Penh Municipal Court over a 2015 effort to murder Mr. Lyhour, then Ms. Kimly’s boyfriend.

Ms. Kimly is accused of asking Mr. Dang Dong to arrange the murder. In court, he admitted that Ms. Kimly handed him a gun, photographs of the intended victim and his address.
“Kimly said if I was successful, she would get me a new motorbike and give me some money,” he told the court.

Mr. Dang Dong claimed he then arranged for Mr. Soi Binh to carry out the shooting.

Mr. Soi Binh admitted to the court that he was promised $10,000 and was handed a gun, but claimed he buried the weapon, before visiting the intended victim and requesting money after producing his photos.

Ms. Kimly told prosecutors that she started dating Mr. Lyhour while she was still with her Singaporean husband, but decided that she wanted him dead after he admitted he was only with her for her money...

Five sentenced over Phnom Penh grenade attack

- Phnom Penh Municipal Court has delivered life sentences to three people and 30-year jail terms to two more for their roles in a grenade attack in the capital’s Boeung Keng Kang III commune in September last year.

The failed assassination plot left several people injured after the explosive missed its intended target, a shop belonging to 36-year-old Ea Lyhour – the ex-boyfriend of the mastermind – and rolled into street 163 and exploded.

The mastermind, Sok Kimly, 41, and the two men contracted to kill Lyhour – Bun Pheakdey, 32, and Sak Mab, 36 – were on Friday found guilty of premeditated murder and yesterday received life sentences.

Another two – Nou Somban, 33, and Pheakdey’s girlfriend, Bou Sophea, 25 – were found guilty of being accomplices to premeditated murder and were handed 30-year terms.

Kimly and three other people were convicted and sentenced to 10 years in prison each in June over a separate failed 2015 plot to shoot the same ex-boyfriend.

It is true that the murder 'victim' in this case is not actually dead, and the (still very much alive) ex-boyfriend, Ea Lyhour, has even withdrawn his complaint, but it may be too late to save his feisty ex-lover from a life behind bars. Stay tuned.]

Appeal Court reduces sentences of five jailed over murder bid

The Appeal Court on Wednesday upheld the sentences of three men and two women who were convicted in 2017 by Phnom Penh Municipal Court to differing verdicts, ranging from 30 years to a life sentence, for a grenade-attack murder attempt in 2016.

However, the Appeal Court has reduced their sentences from 30 to 10 years and from the life sentence to only 30 years in prison.

Presiding Judge Pol Sam Oeun identified the three men as Sak Mab, 36, Nou Samban, 33, and Bun Pheakdey, 32, and the two women as Sok Kimly, 41, and Bou Sopheap, 25.

Judge Sam Oeun said the Phnom Penh Municipal Court on September 15, 2017, sentenced Kimly to life in prison for being a “mastermind of premeditated murder” under Article 200 of the Criminal Code, while Mab, Samban, Pheakdey and Sopheap were convicted to 30 years in prison each for being an “accomplice of premeditated murder”.

Judge Sam Oeun said they appealed their convictions to the Appeal Court and asked to have their sentences reduced.

He added that the Appeal Court heard their appeal trial on September 30.

“Based on the trial and their confessions, the Appeal Court has found them guilty,” Judge Sam Oun read the verdict. “Therefore, the Appeal Court has decided to uphold the ruling dated September 15, 2017, of Phnom Penh Municipal Court.”

“However the Appeal Court reduces the sentence of Kimly to only 30 years in prison, and the sentences of Mab, Samban, Pheakdey, and Sopheap, to only 10 years each,” he added.

The five convicts could not be reached for comment.

According to a court document, in 1998 Kimly married a Singaporean businessman Robert Tan, and they lived together in Phnom Penh’s Chamkar Mon district.

It said in 2015, due to Tan working abroad a lot, Kimly began a love affair with a businesssman Ear Lihour.

It added that in mid-August 2016, Kimly hired Sopheap to find a hitman to kill Lihour in exchange for $20,000.

Sopheap contacted her husband Pheakdey who hired his friend Samban as the hitman, who in turn recruited Mab to be his accomplice, the document said.

It said Kimly gave Pheakdey a gun and $10,000, promising that the other $10,000 would be paid after Lihour was killed.

Pheakdey hired Samban and Mab to do the deed for $5,000, it added.

The document stated that at 7pm on September 6, 2016, after not finding an opportunity to shoot Lihour, Mab and Samban threw a grenade into what they believed was his house in Chamkar Mon district, and fled.

“They threw it in the wrong house, seriously injuring four people and damaging four cars,” the document said.

The five accused were later arrested at different places in Phnom Penh on September 24, 2016.

A woman convicted of masterminding a 2016 grenade attack in central Phnom Penh targeting her cheating boyfriend made an appeal at the Supreme Court that she had only sought for him to be threatened.

The Supreme Court on Tuesday heard appeals from the defendant as part of two linked cases over a tumultuous relationship that have seen convictions against the woman and seven accomplices.

The attack took place in early September 2016 when two people on a motorcycle were seen in leaked CCTV footage throwing a grenade on Street 163 in Boeng Keng Kang III, after which a white SUV drove over the exploding ordnance. The blast injured four bystanders and damaged three vehicles.

After initially being pegged as a larger attack by a National Police spokesperson, Sok Kimly and four others were arrested for attempting to murder her boyfriend Ear Lyhour. Three Vietnamese nationals were also arrested for attempting to kill Lyhour in a separate attack — again at the alleged behest of Kimly, though an attack was not carried out.

Kimly, Bun Pheakdey and Sak Mab were convicted for premeditated murder and sentenced to life in prison and two others, Nou Somban and Pheakdey’s girlfriend Bou Sopheap, were convicted as accomplices to the crime and imprisoned for 30 years.

The prosecution’s case alleged that Kimly had hired Pheakdey and Sopheap to kill her boyfriend, and they then hired Mab to assist. Pheakdey and Mab were on the motorcycle when Mab threw the grenade.

An Appeal Court panel upheld the verdict but reduced the three life sentences to 30 years in prison each.

However, defense lawyer Yon Bunna asked for the case to be sent back to the Appeal Court because it had ignored testimony that could exonerate Kimly. The accused wanted Pheakdey to only threaten her boyfriend but had not instructed anyone to kill him, Bunna said, adding that Pheakdey went above and beyond Kimly’s brief.

“Her intention was to use violence, because she loved Lyhour so much and this led to jealousy and did not want him to have a mistress outside,” Bunna said, adding that Kimly wanted at most Lyhour’s limbs broken and would have used better options than a grenade attack to kill him if she wanted to do so.
