Girls ‘tortured’ by Kratie major get legal assistance

The Samdech Techo Sen Volunteer Lawyers – a legal-aid group set up by Prime Minister HE to assist the poor – will represent two girls who were allegedly assaulted by the commander of the Military Police in Kratie town for the death of his dog.
The group decided to take the case after tales of Tep Huy’s violent conduct came to light on social media. The two girls are cousins and both are 12 years old. They are residents of Kanhchor commune’s Kanhchor village in Kratie province’s Chhlong district who went to work as housemaids for Huy, earning a salary of $100.
In a video clip that went viral on social media, the girls say they were beaten and tortured by Huy, 42, on October 27.
“The homeowner, Tep Huy, beat me, then he called my cousin to come over to him and he pulled her hair and hit her head on the floor. He then hit her head with a rubber stool and even made her eat dog dung and sleep at the dog’s burial site for one night,” one of the girls narrates in the video clip.
“When Tep Huy hit me, he put his foot on my neck and then one of his men wearing a white shirt came and slapped me in the face,” she says.
In the same video clip, the mother of one of the girls says that after this incident, Huy wanted to mediate the dispute and end it by giving her $20,000 but she refused and called for justice in court.
“He wanted to offer me $20,000 as long as I agreed to withdraw the complaint and he accepted the mistake and apologised. But I said I do not want it because you used violence against my 12-year-old child.
“They do not know anything yet. No matter how wrong they were, he should not have hurt my child to that extent. So I asked for help from others to seek legal justice because we are poor victims,” she says.

Multiple aspect and points of view in this.
Without doubt, his conduct is inexcusable. But there are a few things related to the young girls behaviour that really could be better explained and understood.
I don’t wholly condone it, but it’s a fact that children at that age (12) are working. It’s Cambodia, in the provinces. Im sure every charitable organisation in the western world would like to see each and every one of these children in full time education until 16yrs old, at least. But once you start looking, you see how inconsistent that is, both in the provinces and in the city.
I have witnessed first hand the callous treatment of animals by children like this, who are barely mature enough to take responsibility for much of anything, while at the same time are expected to contribute to the family as near adults. Children follow adults lead, whether it’s deliberate teaching or just learning by example. Many animals are treated like toys, as a game. Few children take care with the animals they themselves cherish, as they’ve not been taught properly.
Just a few days ago, I saw a group of road construction workers on highway 5 taking turns at throwing stones at a small family of ducks. Many adults fail to teach the children, and it’s a frequent and repeatable sight across the country. I’ve let a few of these adults have the full force of my anger on a number of occasions. Whether it’s changed their ideas or not, I don’t know. But certainly among the extended family out in Pursat, the stupidity I’ve seen before hasn’t been repeated in front of me in a while.
There’s a tendency here, among many folk in positions of authority to exploit and abuse the privileges. Given this fella’s responses, it would not be a surprise to find that his own kid has adopted his lofty contempt for the people they perceive as beneath them. So, the poor parenting isn’t entirely related to social background and opportunity.

Any mother who sends her 12 year old daughter to be a housemaid isn't financially well heeled. Therefore, to turn down $20,000 (16.6 years salary) is a remarkably brave and principled decision.
The fact that a very senior police officer and his deputy are now in prison on pre trial detention shows the courts do have some teeth when they want to.
Let's hope that, upon any conviction, the court makes a compensation order in addition to any prison term. In this way people might start to see the full court procedure route is better than just allowing rich and powerful people to pay their way out of trouble.
Less 'pay and walk away', more 'pay and prison'.

First rule of negotiating: don't take the first offer. Sasa also make bold claims and ended up accepting an undisclosed amount. Wouldn't surprise me if they do the same (though obviously he'll likely do some jail as the media has luckily taken over). Kratie Commander Accused of Torture and Assault on 12Yo Girl Cousins
Cambodia News (Phnom Penh): On the morning of 22 July 2022, the Supreme Court decided to release a former Kratie Municipal Gendarmerie Commander on bail in connection with crimes of torture and aggravated assault on two female minors living at his home. Nil Nonn, Chief Justice of the Supreme Court, said that the 42 year old accused Tep Huy was a former commander of the Kratie Municipal Gendarmerie.
The two victims were two 12-year-old girls, cousins of the accused, who were sent to work as servants for the accused's family, who live in Kanhchor Village, Kanhchor Commune, Chhlong District, Kratie Province. The accused was charged with intentional aggravated assault towards the two girls in 2021, including death threats, beatings, and torture.
The girls complained of this mistreatment to their mother, who then filed a complaint with the police, and the accused, Tep Huy, was taken in custody on 30 October 2021. Then, on 1 November 2021, the judge at the Kratie Provincial Court ordered the accused to be maintained in pretrial detention on charges of “torture and aggravated assault, intentional aggravated violence, and threatening to murder” in contravention with Articles 211, 219, and 33 of the Penal Code of Cambodia.
The defendant appealed, but the Tbong Khmum Provincial Court of Appeal upheld his sentence. However, his subsequent appeal to the Supreme Court on 22 July was successful, as the judge decided to release the accused on bail.
