Couple Arrested for Bangladeshi Human Trafficking Ring in Phnom Penh

Cambodia News (Phnom Penh): On August 2, 2020, Mr. Mao Sina, the judge of Phnom Penh court, ordered the detention of a Cambodian Bangladeshi couple for human trafficking on February 2, 2020.

The officer of the department of human trafficking and minor protection said that, following a complaint filed by 4 victims who were representing the 16 Bangladeshi victims, the police arrested a couple named MOHAMMAD JAHNGIR, a 35 year old Bangladeshi, director of CEB BIC CIES CO,Lld, and his Wife, Mom Sokhum, 27 years old, on July 30, 2020,

On February 2, 2020, 16 Bangladeshi people came to Cambodia through Phnom Penh international Airport, with CEB BIC CIEB CO.LTD company. The suspects took them to stay at a house near the company for a while and the director told them that he would arrange jobs for them, promising 450 USD pay per month and saying that he would prepare one year visa for them.

Before leaving Bangladesh, the suspect told the Bangladeshi workers to pay him 3000 USD per person for the plane ticket and for finding them a job when they arrived in Cambodia. But once the victims had arrived in Cambodia, he asked for another 500USD and he took all their passports. After that, the suspect took them to work at a construction site, but the victims didn't get paid.

The police said the victims got lured by the suspect's promises of finding them legal work in Cambodia, but victims worked at the construction site without a work permit. The police also said Cambodia does not have a law or any agreement to recruit workers like this from Bangladesh.
After arresting the suspects, the police confiscated 24 passports. The suspects were detained following the judge's order.

Another company exploiting Bangladeshi workers in Cambodia was shut down by police earlier this year.

Cambodia News (Phnom Penh): On the morning of 17 August 2022, the Phnom Penh Municipal Court of Appeal heard the appeal of a Bangladeshi man and a Cambodian woman involved in the illegal smuggling of 16 Bangladeshi workers into Cambodia to work in Phnom Penh during 2020.

Ms. Khieu Sokha, President of the Trial Chamber, stated at the hearing that the two defendants were:
1. 37 year old director of CEB BIC CIES CO., Lld., MOHAMMAD JAHNGIR,Bangladeshi
2. 30 year old Mam Sokhom, Cambodian
The married couple were arrested by police for human trafficking on 30 July 2021, in Thmor Koul 2 Village, Sangkat Choam Chao, Khan Por Senchey, Phnom Penh.
On 15 November 2021, the two were sentenced by the Phnom Penh Municipal Court to 7 years in prison each for illegal human trafficking for exploitation.
However, they have now appealed their sentences, and the Phnom Penh Municipal Court of Appeal will announce the appeal verdict on the morning of 16 September 2022.

Cambodia News, (Phnom Penh): On the morning of March 16, 2023, the Phnom Penh Supreme Court heard the appeal of a Bangladeshi man and a Cambodian woman, a married couple, who were each sentenced to 7 years in prison for human trafficking migrant workers from Bangladesh, in Phnom Penh in 2020.

Mr. Soeng Panhavuth, Chief Judge of the Supreme Court, stated that the two accused are:
1. Mam Sokhom, female, 27 years old, Cambodian.
2. MOHAMMED JAHANGIA, Male, 37 years old, Bangladeshi, Director of CEB BIC CIES CO, Lld.

They were arrested on July 30, 2021 in Thmor Koul village, Choam Chao commune, Por Sen Chey district, Phnom Penh. On November 15, 2021, the two defendants were each sentenced by the Phnom Penh Municipal Court to 7 years imprisonment on charges of trafficking migrant workers, under Article 8 and Article 12 of the Law on the Suppression of Human Trafficking and Exploitation.

The couple appealed their sentences in August 2022, but the Phnom Penh Appeal Court upheld the lower court's decision, so they went on to appeal to the Supreme Court, which has postponed the announcement of the verdict until the morning of March 30, 2023.

UPDATE: Appeal Denied!

Cambodia News, Phnom Penh: On 30 March, 2023, Mr. Soeng Panhavuth, Chief Judge of the Supreme Court, stated that the two accused are guilty as charged and upheld their sentences.
1-Mam Sokhom, female, 27 years old, Cambodian.
2 -MOHAMMED JAHANGIA, a 37-year-old Bangladeshi man, director of CEB BIC CIES CO, Lld.

In this case, the two defendants were sentenced by the Phnom Penh Municipal Court on November 15, 2021 to 7 years imprisonment on charges of trafficking in persons under Article 8 and Article 12 of the Law on the Suppression of Human Trafficking and Sexual Exploitation. The defendents were held responsible for the trafficking and exploitation of 16 Bangladeshi migrant workers.

The couple have now exhausted their possibilities of appeal.

Bangladeshis’ claim against ex-employer stuck in court
Nine Bangladeshi men, formerly employed as migrant workers in Cambodia, yesterday requested assistance from authorities.

The men alleged a Bangladeshi-owned-company owes them two years of back salary, which has not been paid yet even after a Cambodian court ordered the owner to pay them a total of $38,880.

Molia MD Towhid Newal, one of the nine Bangladeshi men and their representative, told Khmer Times yesterday that on January 22, 2020 they were persuaded by Alam Mohammed Jahangia, BC Builder Investment Co. Ltd. through the Bangladeshi Embassy in Thailand to take employment with his company in Phnom Penh.

Newal said that he and the other eight men agreed to work for Jahangia. After signing the contract and receiving the first installment of their $400 monthly salary, they arrived in Cambodia on February 14, 2020 and started to work for Jahangia and his company in Phnom Penh’s Russei Keo district.

He said that for the first month of their work, they were each paid $300.

He added that after the second month of work, they did not receive any salary besides little payments of $5 to $10 each, as a food allowance.

Newal said that they were forced to quit working for Jahangia since he stopped paying their salary after the second month. They stopped working on April 30, 2020.

He added that had confiscated their passports and refused to pay them their outstanding salaries.

He noted that they lodged a lawsuit against Jahangia through the Phnom Penh Municipal Court on July 28, 2021 to demand their salaries.

Newal said that on August 25, 2021, the Phnom Penh Municipal Court ruled in their favour and ordered Jahangia to pay $4,320 compensation to each of them for a total of $38,880.

However, Jahangia has not complied with the ruling, he said.
